公共工程招投标领域的腐败预防问题研究

【摘要】：目前,公共工程招投标已成为我国公共工程市场的一种主要交易形式，由于我国体制、机制与法制不健全等因素，招投标市场中尚存在许多违法甚至严重的腐败行为。因此，笔者认为对公共工程招投标领域的腐败预防问题进行研究有着非常重要的现实意义。本文首先阐述了招投标制度以及公共工程招投标的特征和一般运作程序，，然后分析了公共工程招投标腐败行为的主要特征与主要表现形式，进而深入探究了公共工程招投标腐败行为的成因，最后结合国内外公共工程招投标领域腐败预防的实践经验，笔者试图从健全公共工程招投标程序的公开制度、建立独立和权威的监督机构、完善招投标法相关法律和法律责任制度三个方面提出了完善我国公共工程招投标腐败预防问题的具体对策建议。
[Abstract]:At present, public works bidding has become one of the main forms of transaction in the public works market of our country. Due to the imperfect system, mechanism and legal system of our country, there are still many illegal and even serious corrupt behaviors in the bidding market. Therefore, the author thinks that it is of great practical significance to study the prevention of corruption in the field of public works bidding. This paper first describes the system of bidding, the characteristics of public works bidding and general operating procedures, and then analyzes the main characteristics and main forms of public works bidding corruption. Then it probes into the causes of corruption in public works bidding and bidding. Finally, combining with the practical experience of preventing corruption in the field of public works bidding and bidding at home and abroad, the author tries to perfect the open system of public works bidding procedure. To establish an independent and authoritative supervision institution and to perfect the law and legal liability system of bidding law, this paper puts forward some concrete countermeasures and suggestions for improving the prevention of corruption in public works bidding and bidding in China.
