我国烟草专卖行政指导存在的问题与对策研究

【摘要】：为有效解决烟草专卖行政执法实践中存在的问题,努力构建“依法行政、善于管理”的柔性化烟草专卖执法模式,各级烟草部门将国内外流行的行政指导制度引入到烟草专卖行政执法工作中,行政指导这一创新服务管理模式在实践表明其有利于烟草专卖管理更加趋于民主、高效行政,进而逐步转型成“服务型”的行政管理机关。本篇论文共分有三个部分:第一部分,主要针对行政指导的法理进行分析研究,一方面在总结概括国内教授、学者关于行政指导的研究成果的基础上,对烟草专卖行政指导进行了相关定义并分析了其性质,同时还分析介绍了行政指导的类型和作用;另一方面阐述了我国烟草专卖行政指导的法学理论和法律实践基础。第二部分,本部分首先通过追溯烟草专卖行政指导的背景及发展,明晰当前烟草专卖行政指导发展阶段;其次,结合工作实践总结出行政指导在烟草专卖执法中的七种基本形态,同时分析了烟草专卖行政指导的实践效果;最后,明确指出了当前烟草专卖行政指导理论研究、工作实践中存在主要问题,在指明问题的同时从四个方面即思想观念、职能转变、人员素养、制度建设对存在的问题进行了深入的原因剖析。第三部分,本部分为寻找到有效的解决对策,首先,针对实践中存在的理论研究运用方面的问题,建议采取理论研究和实践借鉴的方式弥补烟草专卖行政指导理论实践研究方面的短板;其次,通过提高专业技能和法治素养、树立正确认识的方式转变旧有的行政指导执法观念和执法部门职能;第三,指出在实践运用中进一步的明晰烟草专卖行政指导的适用范围和原则、细化行政指导的决策和执行程序等内容统一纳入到行政指导规则之中,确保烟草专卖行政指导工作在各级烟草部门落实中做到统一性;第四,在解决相对人的救济制度缺陷方面,建议通过修改相关法律和制定法规的方式扩大行政指导的救济范围,同时完善归纳了不同的行政指导所能引起的法律责任;第五,建立信息共享、行为公开、工作咨询三项配套辅助性制度共同解决烟草专卖行政指导过程可能存在的异化、违法及不作为问题。
[Abstract]:In order to effectively solve the problems existing in the practice of tobacco monopoly administrative law enforcement, we should try to construct a flexible tobacco monopoly law enforcement model, which is "administrating according to law and good at management". Tobacco departments at all levels have introduced the popular administrative guidance system at home and abroad into the administrative law enforcement work of tobacco monopoly. Administrative guidance, an innovative service management mode, has been proved to be beneficial to tobacco monopoly management by becoming more democratic and efficient in practice. And then gradually transformed into a "service-oriented" administrative organs. This thesis is divided into three parts: the first part mainly focuses on the legal theory of administrative guidance, on the one hand, on the basis of summarizing the research results of domestic professors and scholars on administrative guidance, The related definition and nature of tobacco monopoly administrative guidance are analyzed, and the types and functions of administrative guidance are also analyzed. On the other hand, it expounds the legal theory and legal practice basis of administrative guidance of tobacco monopoly in China. The second part, this part first by tracing the background and development of tobacco monopoly administrative guidance, clarify the current development stage of tobacco monopoly administrative guidance; Secondly, combined with the working practice, this paper summarizes seven basic forms of administrative guidance in the enforcement of tobacco monopoly, and analyzes the practical effect of administrative guidance on tobacco monopoly. Finally, the paper points out the main problems in the current research of tobacco monopoly administrative guidance theory and work practice. At the same time, it points out the problems from four aspects, that is, ideology, function change, personnel accomplishment, and so on. The system construction has carried on the thorough analysis to the existence question. The third part, this part is divided into to find the effective solution countermeasure, first, in view of the practical existence theory research application aspect question, It is suggested that theoretical research and practical reference should be adopted to make up for the deficiency in the theoretical and practical research of tobacco monopoly administrative guidance. Secondly, by improving professional skills and legal literacy, to establish a correct understanding of the way to change the old concept of administrative guidance and law enforcement functions; Thirdly, it is pointed out that the application scope and principle of tobacco monopoly administrative guidance should be further clarified in practice, and the contents of administrative guidance decision-making and implementation procedures should be unified into the administrative guidance rules. To ensure the unity of tobacco monopoly administrative guidance in the implementation of tobacco departments at all levels; Fourthly, in the aspect of solving the defects of the relative person's relief system, it is suggested that the relief scope of the administrative guidance should be expanded by amending the relevant laws and regulations, and at the same time perfecting and summarizing the legal responsibility which the different administrative guidance can cause; Fifthly, establish three auxiliary systems of information sharing, behavior publicity and job consultation to solve the possible alienation, illegality and omission of tobacco monopoly administrative guidance process.
