中国网络舆情行政监管的法律问题研究

【摘要】：互联网打破了传统媒体传播的时空界限，作为信息传播、文化宣传的重要载体，其具有开放性高，互动性强，信息量大的特点，在当前的舆情格局、信息传播中发挥着无法取代的关键作用。但是，网络舆情的内容已经深深影响了网络之外的社会总体的态度、思想意识、价值取向，从而使得网络舆情的监管变得愈发重要和迫切。由于网络舆情传播的速度快、范围广、互动性强，以及传播主体的匿名性等特征，网络舆情的影响力越来越大，网络变成了很多议题和行为的孵化场所。正面的网络舆情可以起到弘扬正气、鞭笞邪恶、促进社会发展的作用，负面的网络舆情有可能引起网络暴力事件、降低政府公信力，甚至影响司法公正。目前我国对于网络舆情采取的监管绝大部分是行政监管，但是在实际的监管中依然存在着一些漏洞，也发现了一些问题。在这种情况下，应当通过法律的介入，依法监管网络舆情，对于网络信息传播时出现的违法行为设置相应的行政处罚。在监管过程中要注意协调相关的利益，通过权威性的立法和相关法律的完善，明确各政府部门对于网络监管的职责范围，使得政府机关、司法机构在网络舆情监管中有法可依，提高执法效果。同时对于网络舆情不能一味地运用堵和拦的传统监管方式，可以通过引入新闻发言人、第三方发言人，培养意见领袖，设立法院限制令，加强政府信息公开，建立政府的舆情监测和评估系统等多种方式和手段达到网络舆情监管的最终效果。
[Abstract]:The Internet has broken the time-space boundary of traditional media communication. As an important carrier of information dissemination and cultural propaganda, it has the characteristics of high openness, strong interaction and large amount of information. Information dissemination plays an irreplaceable key role. However, the content of network public opinion has deeply affected the overall attitude, ideology and value orientation of the society outside the network, which makes the supervision of network public opinion become more important and urgent. Because of the rapid spread of network public opinion, wide range, strong interaction, as well as the anonymity of the subject, the influence of network public opinion is growing, and the network has become the incubator of many issues and behaviors. The positive network public opinion can carry forward the positive spirit, whip the evil, promote the social development function, the negative network public opinion may cause the network violence event, reduce the government credibility, even affect the judicial justice. At present, most of the supervision of network public opinion in our country is administrative supervision, but there are still some loopholes and problems in the actual supervision. In this case, the network public opinion should be supervised according to law through the intervention of law, and the corresponding administrative punishment should be set for the illegal behavior that occurs during the dissemination of network information. In the process of supervision, we should pay attention to the coordination of relevant interests. Through the improvement of authoritative legislation and related laws, we should make clear the scope of responsibilities of various government departments for network supervision, so that government organs and judicial institutions can abide by the law in the supervision of network public opinion. Improve the effectiveness of law enforcement. At the same time, public opinion on the Internet cannot blindly use the traditional way of supervision of blocking and blocking. It can strengthen the publicity of government information by introducing press spokesmen, third-party spokesmen, training opinion leaders, setting up court restraining orders, and strengthening the publicity of government information. Establish government monitoring and evaluation system of public opinion and other ways and means to achieve the final effect of network public opinion supervision.
