美国水力压裂强制披露制度及其启示——基于得克萨斯州的经验分析

【摘要】：基于化解公众对水力压裂环境污染担忧、促进本州油气产业发展以及保持州对油气产业规制权等的需要,美国得州制定了以水力压裂液化学物质强制披露制度为核心的水力压裂化学物质披露法。该法较为科学地规定了水力压裂化学物质强制披露的义务主体、方式、信息范围和法律责任等内容。借鉴得州经验,我国应当研究出台权义具体明确、披露方式便捷易用、披露信息范围合理的水力压裂强制披露法律法规。
[Abstract]:In order to resolve the public's concern about environmental pollution caused by hydraulic fracturing, to promote the development of oil and gas industry in this state and to maintain the state's right to regulate oil and gas industry, Texas has formulated a hydraulic fracturing chemical disclosure method which is based on the mandatory disclosure system of hydraulic fracturing fluid chemical substances. The method scientifically prescribes the subject, mode, information scope and legal liability of the compulsory disclosure of hydraulic fracturing chemical substances. Based on the experience of Texas, our country should study the laws and regulations of mandatory disclosure of hydraulic fracturing with clear meaning, convenient and easy to use, reasonable scope of disclosure information.
