延边朝鲜族自治州养老服务条例立法构想

【摘要】：本文从分析延边州的立法概况入手,引出延边州的立法优势以及延边州制定新条例的可行性。接着简述了延边州养老服务的现状,在此基础上分析了延边州养老服务存在的主要问题,引出了延边州养老服务存在的问题需要法律进行调整,并从延边州养老服务的社会影响,修改现行法律的困境等方面分析了延边州针对养老服务需要制定专门立法的必要性。最后从制定延边州养老服务条例的立法目的,立法原则出发,概括出条例应包含的内容,进行提出了笔者有关延边州养老服务的立法构想。本篇论文主要是结合延边州养老服务的实际情况以及存在的问题,阐明延边州人口结构趋于严重老龄化,当务之急应是不遗余力的保障养老服务的平稳发展,进而加快养老服务的立法进度。本文共分为五大部分:第一部分是前言。这部分主要从研究背景、研究目的以及研究意义说明本文的写作意图,为下文写作起引导作用。第二部分是有关延边州立法概况。叙述延边州至今制定法律、延边州为何会有这些立法成就,在理论上进行分析引出在延边州立法优势,解析老年人保障条例,提出延边州制定养老服务专门立法可行性。第三部分是有关延边州养老服务现状。该部分主要介绍了延边州当下的养老服务体系运营、养老服务内容、养老服务队伍、养老服务机构建设和养老服务水平,进而介绍了延边州的养老服务业存在的主要问题,间接引出了相应立法的重要性。第四部分是对延边州养老服务进行专门立法的必要性的介绍和说明。从养老服务的发展对延边州的影响、对此行业持续发展的需求到满足老年人养老保障要求来说明,叙述为何不能修改相关现行条例,为延边州的和谐发展,针对养老服务专门立法在延边州经济、社会稳定有着不可缺少的作用进行分析。第五部分是笔者对延边州养老服务专门立法内容的具体构想。从延边州制定养老服务专门立法目的出发,论述延边州在制定相关立法过程中需遵循的原则,最后条例内容应包含从老年人权益保护为出发点、确立有关养老服务的保障途径、对养老服务的技术标准进行规范化和专业化、规定建立养老服务纠纷处理机制,提出构建延边州养老服务法律制度的具体建议。
[Abstract]:This paper analyzes the legislative situation of Yanbian prefecture, leads to the legislative advantages of Yanbian prefecture and the feasibility of making new regulations in Yanbian prefecture. Then the paper briefly introduces the present situation of the old-age service in Yanbian prefecture, and then analyzes the main problems existing in the old-age service in Yanbian prefecture, and leads to the problems existing in the old-age service in Yanbian prefecture, which need to be adjusted by law. It also analyzes the necessity of making special legislation to meet the needs of pension service in Yanbian prefecture from the aspects of social influence of pension service in Yanbian prefecture and the predicament of modifying the current law. Finally, from the legislative purpose and the legislative principle of formulating the regulations on old-age service in Yanbian prefecture, this paper summarizes the contents that should be included in the regulations, and puts forward the legislative ideas of the author about the old-age service in Yanbian prefecture. This paper mainly combines the actual situation and the existing problems of the old-age service in Yanbian prefecture to clarify that the population structure of Yanbian prefecture tends to be aging seriously, and the urgent task is to spare no effort to ensure the smooth development of the old-age care service. And then speed up the legislative progress of pension services. This paper is divided into five parts: the first part is the preface. This part mainly explains the writing intention of this paper from the research background, research purpose and research significance, and plays a leading role in the following writing. The second part is about the general situation of Yanbian state legislation. This paper narrates that Yanbian prefecture has made laws up to now, and why Yanbian prefecture has made these legislative achievements, analyzes the advantages of legislation in Yanbian prefecture, analyzes the regulations on the security of the elderly, and puts forward the feasibility of making special legislation on pension service in Yanbian prefecture. The third part is about the present situation of pension service in Yanbian prefecture. This part mainly introduces the current pension service system operation, pension service content, old-age service team, old-age service organization construction and old-age service level in Yanbian prefecture, and then introduces the main problems of pension service industry in Yanbian prefecture. Indirectly leads to the importance of the corresponding legislation. The fourth part introduces and explains the necessity of special legislation on pension service in Yanbian Prefecture. From the impact of the development of old-age service on Yanbian prefecture, the demand for sustainable development of this industry to meet the requirements of old-age security for the elderly, this paper describes why the relevant existing regulations cannot be amended to ensure the harmonious development of Yanbian prefecture. The special legislation of pension service plays an indispensable role in the economy and social stability of Yanbian Prefecture. The fifth part is the author's specific conception of the special legislation content of the pension service in Yanbian Prefecture. Starting from the purpose of making special legislation on old-age service in Yanbian prefecture, this paper discusses the principles that should be followed in the process of making relevant legislation in Yanbian prefecture. Finally, the contents of regulations should include establishing the safeguard ways of old-age service from the point of view of the protection of the rights and interests of the elderly. This paper standardizes and specializes the technical standard of old-age service, prescribes the establishment of dispute handling mechanism of old-age service, and puts forward some concrete suggestions for constructing the legal system of pension service in Yanbian Prefecture.
