行政许可权力规制的理论脉络:以国家权力结构法治化为视角

【摘要】：行政许可是国家管理社会经济、政治、文化等事务的一种事前控制手段,在政府部门的规范性文件中习惯于将其称为"行政审批"。长期以来我国行政许可处于一种权责严重失衡的状态,对行政许可的监督较为疲软,甚至在《行政许可法》颁布实施之后,此种乱象也并未能根本改观。因此,有必要对行政许可监督的制度进行理论检索与梳理,以期能探寻出对实践较为有助益的理论指导。从根本而言,对于行政许可的监督需要把握好权力脉络,其监督制度的完善还应追根溯源于宪法所架构的国家权力,以权力结构法治化作为完善行政许可监督理论及制度实践的思考方向。
[Abstract]:Administrative license is a means of controlling social economy, politics, culture and so on, which is used to be called "administrative examination and approval" in the normative documents of government departments. For a long time, the administrative license in our country has been in a state of serious imbalance of power and responsibility, and the supervision of administrative license is relatively weak. Even after the promulgation and implementation of the Administrative Licensing Law, this disorder has not fundamentally changed. Therefore, it is necessary to search and comb the system of administrative license supervision theoretically, in order to explore the theoretical guidance which is more helpful to practice. Fundamentally speaking, the supervision of administrative licensing needs to grasp the context of power, and the perfection of its supervisory system should be traced back to the state power under the framework of the Constitution. Taking the rule of law by power structure as the thinking direction to perfect the theory and system practice of administrative license supervision.
