国家能力建设视角下的土地用途管制制度探析

【摘要】：对中国而言,土地问题的有效治理一直是国家能力的重要体现,其中,围绕土地管控所进行的国家筹集资源能力建设一直贯穿其间,并经历了诸次调整与重构。与此同步,国家与社会、中央与地方亦进行着互动。作为国家土地管控基本制度之一的土地用途管制制度,正是在这样的过程中生成与展开的,该制度的形成过程是国家能力建设的一个缩影与折射,而该制度实施中所呈现出来的乏力,亦是国家权力基础转变,以及相应的国家能力建设模式转向之集中体现。
[Abstract]:For China, the effective governance of land issues has always been an important embodiment of national capacity. Among them, the construction of national resource raising capacity around land management and control has been running through it, and has experienced various adjustments and reconstruction. At the same time, the state and society, the central and local interaction. As one of the basic systems of national land control, the land use control system is generated and developed in such a process. The forming process of the system is a microcosm and refraction of national capacity building. The weakness in the implementation of the system is also a concentrated reflection of the transformation of the state power base and the corresponding national capacity-building model.
