我国宅基地使用权流转的地方立法文本实证研究

【摘要】：长期以来我国一直实行城乡二元土我国国情的宅基地使用权流转方式。本文对现阶段各地关于宅基地使用权流地制度,在这种制度下我国对农村宅基地及附属设施的流转采取严格的限制,因此造成农村宅基地与住房大量空置,这不仅极大地阻碍了农村的经济发展,而且也引发了许多社会矛盾。随着我国社会经济的快速发展,城镇化水平的不断提升,现有的土地制度已经不符合我国社会发展的需要,为妥善解决宅基地及其地上附属房屋流转这一问题,许多地方已经着手进行试点改革,试图探索出一种适合转的立法文本进行收集并分析,试图发现各地在宅基地使用权流转过程中存在的问题,并提出相应的对策,以期为我国构建合理的宅基地使用权流转机制提供现实的支撑。在此背景下,本文在查阅大量文献资料及各地规范性文件的基础上,收集了15个地方规范性文件进行研究比较。本文内容主要包括三部分,第一部分分别从调查背景及目的、文本收集方法、文本收集范围等方面入手进行介绍。第二部分首先对涉及宅基地使用权流转的地方立法文本的总体情况进行概述,然后就宅基地使用权流转地方立法文本的内容分别从主体、客体、流转方式、流转地价、交易年限、流转所得利益分配等几方面进行分析。第三部分分析了当前宅基地使用权流转中存在的问题,并在此基础上提出有关具体对策。
[Abstract]:For a long time, our country has been carrying out the circulation of the right to use the homestead in the dualistic land of urban and rural areas. Under this system, we take strict restrictions on the circulation of rural homestead and its ancillary facilities, resulting in a large number of vacant rural homestead and housing. This not only greatly hindered the rural economic development, but also caused many social contradictions. With the rapid development of China's social economy and the continuous improvement of urbanization level, the existing land system has not met the needs of the social development of our country. In order to properly solve the problem of the circulation of homestead and its attached houses on the ground, Many places have begun to carry out pilot reform, trying to explore a suitable legislative text for collection and analysis, trying to find out the problems existing in the circulation of the right to use the homestead, and put forward the corresponding countermeasures. With a view to building a reasonable homestead transfer mechanism to provide practical support. Under this background, this paper collects 15 local normative documents on the basis of consulting a lot of documents and normative documents. This paper mainly includes three parts. The first part introduces the background and purpose of the investigation, the method of text collection, the scope of text collection and so on. The second part first summarizes the general situation of the local legislative text concerning the circulation of the right to use the homestead, and then the content of the local legislative text of the circulation of the right to use the homestead from the subject, the object, the circulation mode, the circulation land price, respectively. Transaction years, the distribution of income from circulation and other aspects of the analysis. The third part analyzes the problems existing in the circulation of the right to use the homestead, and puts forward some concrete countermeasures.
