浅谈警察自由裁量权

【摘要】：警察自由裁量权的行使会提高执法效率,是我国法制建设的不可或缺的一项内容。但是警察自由裁量权的存在也会产生不利影响,严重损害了法制社会的进程。本文主张警察自由裁量权,肯定其权利行使的意义,归纳出权利行使的弊端,得出了这样的结论:对警察自由裁量权进行有效的控制。
[Abstract]:The exercise of the discretion of the police will improve the efficiency of law enforcement and is an indispensable part of the legal construction of our country. However, the existence of the discretion of the police will also have a negative impact, which seriously damages the process of the legal society. This paper advocates the discretion of the police, affirms the significance of the exercise of the right, concludes the malpractice of the exercise of the right, and draws such a conclusion: effective control of the discretion of the police.
