政府重大行政决策程序法律制度研究

【摘要】：政府重大行政决策有可能存在对社会稳定、环境保护、依法行政等因素的不利影响。行政决策机制、风险评估模式和合法性审查机制等问题给政府重大行政决策带来各种风险。对政府重大行政决策的主要事项和各种风险进行类型化是完善政府重大行政决策程序法律制度的理论前提和制度基础。事前调研、公开听证、公众参与、合法性审查、集体讨论决定、跟踪决策效果和纠错机制等程序机制是政府重大行政决策程序机制的法律制度基础。在社会稳定、环境保护、经济发展、法律和政策等方面进行合法性、合理性、可行性和可控性的风险评估和合法性审查成为政府重大行政决策的重要内容。此外,一旦政府重大行政决策失误造成严重后果便需要建立相应的法律责任追究机制。因此,完善政府重大行政决策程序法律制度有助于政府重大行政决策的科学化、程序化和法治化。
[Abstract]:Major administrative decisions of the government may have adverse effects on social stability, environmental protection, administration by law and so on. The administrative decision-making mechanism, the risk assessment model and the legitimacy examination mechanism bring all kinds of risks to the major administrative decisions of the government. It is the theoretical premise and the system foundation to perfect the legal system of the important administrative decision procedure of the government to classify the main items and various risks of the government's major administrative decision. Prior investigation, public hearing, public participation, legitimacy examination, collective discussion and decision, tracking decision-making effect and error-correcting mechanism are the legal system foundation of the major administrative decision-making procedure mechanism of the government. In the aspects of social stability, environmental protection, economic development, law and policy, legitimacy, rationality, feasibility and controllable risk assessment and legitimacy review become the important content of the government's important administrative decision. In addition, it is necessary to establish the corresponding legal liability investigation mechanism once the serious consequences caused by the government's major administrative decision-making mistakes. Therefore, perfecting the legal system of the major administrative decision-making procedure of the government is helpful to the scientific, procedural and legalization of the major administrative decision making of the government.
