行政许可削减问题研究

【摘要】：行政许可作为国家对社会经济、政治、文化活动进行宏观调控的有力手段，对于社会的良性运转发挥着重要作用。但是随着有限政府理念的提出，人们逐渐意识到现阶段我国行政许可事项过多的现状。过多的行政许可事项不仅限制了市场的经济活力，而且也影响到政府的施政能力，所以为了释放经济社会的活力，构建精简型政府，我们需要削减过多的行政许可事项。学术界和实践部门对于如何削减行政许可存在着较多的争议，本文主要围绕有关行政许可削减的相关问题进行研究，将文章分为以下五个部分：第一章，行政许可削减原因分析。本章首先对行政许可存在的问题及许可执行违背设定目的进行阐述，从而为我们进行许可削减提供依据。其次阐述削减行政许可的根本原因。第二章，行政许可削减的阻力。本章从我国进行行政许可削减所面对的各种阻力进行阐述，揭示出行政许可削减将要面对的问题。第三章，国外行政许可削减的经验借鉴。本章通过对国外相关行政许可削减进行研究，寻找其共性的规则，从而可以为我国的行政许可削减提供有益的经验和应该注意的问题。第四章，行政许可削减的目标、原则与标准。本章首先探讨我们削减行政许可应该达到的目标，其次在削减的过程中我们应该遵循何种原则，这样才能更好的指导实践，最后尝试寻找削减行政许可的一些可参考标准。第五章，行政许可削减的监督。本章通过对行政许可削减的行政行为进行监督，以减少对行政相对人利益的损害。通过多渠道多角度的监督管理，从而使行政许可削减的工作能够正常有序的开展。
[Abstract]:As a powerful means of macro-control of social economic, political and cultural activities, administrative license plays an important role in the benign operation of society. However, with the introduction of the concept of limited government, people gradually realize that there are too many administrative licensing issues in China at this stage. Too much administrative licensing not only limits the economic vitality of the market, but also affects the ability of the government to govern. So in order to release the vitality of the economy and society and build a streamlined government, we need to reduce too much administrative licensing. There are many disputes about how to reduce administrative license in academic and practical departments. This paper mainly focuses on the related issues of administrative licensing reduction, and divides the article into the following five parts: chapter one, The reason analysis of administrative license reduction. In this chapter, the problems existing in administrative license and the disobeying purpose of license enforcement are discussed, which provides a basis for us to carry out license reduction. Secondly, it expounds the root causes of the reduction of administrative license. Chapter two, the resistance of administrative license reduction. This chapter expounds all kinds of resistance of administrative license reduction in our country, and reveals the problems that administrative license reduction will face. The third chapter, foreign experience of administrative license reduction. In this chapter, through the study of foreign related administrative license reduction, to find its common rules, so as to provide beneficial experience and problems that should be paid attention to for the administrative license reduction in our country. The fourth chapter, the goal, the principle and the standard of the administrative license reduction. This chapter first discusses the goal that we should achieve to reduce the administrative license, secondly, what principles should we follow in the course of the reduction, so that we can better guide the practice, and finally try to find some referential standards for the reduction of the administrative license. Chapter V, the supervision of administrative license reduction. By supervising the administrative action of administrative license reduction, this chapter can reduce the harm to the interests of the administrative counterpart. Through multi-channel and multi-angle supervision and management, the work of administrative license reduction can be carried out in a normal and orderly manner.
