二次供水设施产权移交的法律问题探讨

【摘要】：随着国家四部委《关于加强改进二次供水设施建设管理的通知》的下发,全国大部分城市开始进行二次供水改造移交工作。二次供水设施产权和管理权主体不统一导致二次供水问题日益突出,最好的解决办法是通过政府主导,将二次供水设施的产权移交给供水企业。通过讨论公共利益的特性,结合二次供水改造实践,提出二次供水设施的产权移交属于公共利益需要。对公共利益界定主体进行讨论,提出二次供水设施产权移交办法应该由政府制定,司法机关监督,必要时寻求立法支持。
[Abstract]:With the issuance of the Circular on strengthening and improving the Construction and Management of Secondary Water supply facilities by four ministries and commissions, most cities in the country began to carry out the work of secondary water supply transformation and handover. The disunity of property rights and management rights of secondary water supply facilities leads to the problem of secondary water supply becoming more and more prominent. The best solution is to transfer the property rights of secondary water supply facilities to water supply enterprises through the leadership of the government. By discussing the characteristics of public interest and combining with the practice of secondary water supply transformation, it is pointed out that the transfer of property rights of secondary water supply facilities belongs to the needs of public interests. This paper discusses the subject of defining the public interest, and puts forward that the measures for the transfer of property rights of the secondary water supply facilities should be formulated by the government, supervised by the judicial organs and, if necessary, seeking legislative support.
