我国医疗机构管理省级立法现状研究

【摘要】：1994年国务院《医疗机构管理条例》颁布后,我国26个省市区相继制定了医疗机构管理的地方立法。这些地方立法充分利用了上位法赋予的地方立法空间,合理确定本地域内各级卫生行政部门的管理职责,细化审批责任分工,明确对医疗机构执业行为要求,为合理配置医疗资源和规范本地医疗机构执业秩序起到了积极作用。然而,这些地方立法也存在一些缺陷:年久失修、老化现象严重;照抄照搬,盲目重复上位法;过分倚重稳定性差的规章和规范性文件;抱残守缺,鲜有与时俱进的制度设计;违反许可法,增设准入条件;重行政审批,轻执业行为管理。本文在在充分调研全国各省市区的医疗机构管理立法和现有关于医疗机构管理的相关法律法规和政策基础上,通过分析现行省级立法中的亮点和不足,为完善我国医疗机构管理地方立法提出相应建议。
[Abstract]:After the promulgation of the regulations on the Management of Medical institutions by the State Council in 1994, 26 provinces, cities and autonomous regions in China have formulated local legislation for the management of medical institutions. These local legislation make full use of the local legislative space given by the Superior Law, reasonably determine the management responsibilities of the health administrative departments at all levels in their respective regions, refine the division of examination and approval responsibilities, make clear the requirements for the practice behavior of medical institutions, and play a positive role in the rational allocation of medical resources and the standardization of the practice order of local medical institutions. However, there are also some defects in these local legislation: disrepair and serious aging; copying and blindly repeating the upper law; relying too much on regulations and normative documents with poor stability; keeping abreast of defects and rarely keeping pace with the times; violating the licensing law and adding access conditions; emphasizing administrative examination and approval, and neglecting the management of practice behavior. On the basis of fully investigating the management legislation of medical institutions in all provinces and cities in China and the existing laws and regulations on the management of medical institutions, this paper analyzes the bright spots and shortcomings of the current provincial legislation, and puts forward some corresponding suggestions for perfecting the local legislation of medical institutions management in our country.
