电子产品图形用户界面知识产权法律保护

【摘要】：随着信息技术的快速发展，社会对涉及电子产品的图形用户界面的保护需求日益增加。近年来许多知识产权的热点诉讼都集中在该领域。但是由于图形用户界面所具有的集艺术性和操作性为一体的特性，使得该领域的知识产权保护界限比较模糊，如何对其进行合理有效的知识产权保护成为人们关心的问题。 本论文从涉及电子产品的图形用户界面的知识产权诉讼案件为出发点，引出了关于电子产品图形用户界面的知识产权法律保护问题，尝试对图形用户界面这一特殊领域的知识产权客体的保护进行具体的探讨，并结合该领域在世界上各主要国家的知识产权保护情况以及法律和实务操作做出比较研究。根据在中国该产业发展的特殊国情以及现行法律制度及其保护现状，对中国目前针对图形用户界面的知识产权保护制度的适度变化做出了大胆的展望和设想，提出了在中国对电子产品的图形用户界面进行知识产权保护时要具有合理分类、适度放开、保护范围清楚的思路，，并给出了较为具体可行的制度建议，具有一定的理论意义和现实意义。
[Abstract]:With the rapid development of information technology, the demand for protection of graphical user interface (GUI) involving electronic products is increasing day by day. In recent years, a lot of intellectual property rights hot litigation are concentrated in this field. However, due to the artistic and operational features of the graphical user interface, the boundaries of intellectual property protection in this field are rather fuzzy. How to protect the intellectual property rights reasonably and effectively becomes a problem of concern to people. Starting from the intellectual property litigation cases involving the graphical user interface of electronic products, this paper leads to the legal protection of intellectual property in the graphical user interface of electronic products. This paper attempts to discuss the object protection of intellectual property in the special field of graphical user interface, and makes a comparative study on the protection of intellectual property rights in the main countries in the world, as well as the legal and practical operation in this field. According to the special situation of the development of this industry in China, the current legal system and the present situation of its protection, this paper makes a bold outlook and assumption on the moderate changes of the current intellectual property protection system of the graphical user interface in China. This paper puts forward the idea of reasonable classification, proper liberalization and clear scope of protection for intellectual property protection of graphical user interface of electronic products in China, and gives more concrete and feasible system suggestions. It has a certain theoretical and practical significance.
