试论如何缓解我国城市建设中的拆迁矛盾

【摘要】：自从我国改革开放以来,城乡经济高速发展,城市化进程的速度不断加快,我国城市拆迁的规模和广度也随之不断增加,由此伴随而来的拆迁矛盾也在逐渐累积。现阶段，我国正处于社会转型期,在这一特殊的历史阶段,城市拆迁矛盾显得尤为复杂、突出,并由此带来了一系列的社会问题,这其中有些甚至演化为对抗性的冲突,酿成惨剧,引发了政府的公信力流失,动摇了地方政府的合法性基础,严重影响了经济发展与和谐社会的建设。城市拆迁矛盾俨然已成为现阶段我国社会矛盾的集中领域,这些矛盾不但引起了学者的广泛关注,也成为摆在各级地方政府面前一项亟待解决的难题。我国的城市拆迁工作是目前各级、各类政府有效整合资源、实现科学进步发展的必经之路，也是规划城区，提高生活质量的必要方法，但是因为拆迁的独特方式、手段，拆迁工作成为各种社会矛盾的焦点。现阶段，我国城市拆迁过程中，拆迁发起人和执行人将大量的人力和物力都耗费在解决思想工作上，被拆迁人由于个体差别、信息不对称等主客观因素影响，抵触拆迁、漫天要价，这些矛盾导致拆迁方不惜铤而走险违法违规获取暴利，被拆迁人法律意识淡薄、仇视拆迁行为，双方矛盾极为突出。那么，如何能既满足经济进步发展、又能构建社会和谐氛围，，通过合理合法、有序的开展拆迁工作，解决私有财产和公共福利的矛盾，是摆在各大中小城市建设者面前的一道难题，笔者将从公共管理、物权法的角度入手，重点针对我国城市建设过程中存在的主要问题及各渠道建议，逐步驱使拆迁工作公平、公开、公正化，促进城建、房改一体化进步发展。

It has caused the loss of the credibility of the government, shaken the legitimate foundation of the local government, seriously affected the economic development and the construction of a harmonious society. The contradiction of urban demolition and relocation has become a concentrated area of social contradictions in our country at this stage. These contradictions have not only aroused the widespread concern of scholars, but also become a difficult problem to be solved urgently in front of local governments at all levels. The urban demolition and relocation work in China is the only way for all levels of government to effectively integrate resources and realize scientific progress and development at present. It is also a necessary method for planning urban areas and improving the quality of life. However, because of the unique way and means of demolition, Demolition and relocation work has become the focus of various social contradictions. At present, in the process of urban demolition in China, the sponsors and executors spend a lot of manpower and material resources on solving ideological work. Information asymmetry and other subjective and objective factors, such as resistance to demolition, excessive price, these contradictions lead to the demolition party regardless of taking risks, illegal and illegal profits, the legal consciousness of the removed person is weak, hate demolition behavior, The contradictions between the two sides are extremely prominent. Well, how can we not only meet the needs of economic progress and development, but also build a harmonious atmosphere in society, and resolve the contradiction between private property and public welfare through a reasonable, legal and orderly demolition work? It is a difficult problem for the constructors of large, medium and small cities. From the angle of public administration and property law, the author will focus on the main problems existing in the process of urban construction in our country and the suggestions of various channels, which will gradually drive the work of demolition and relocation to be fair. Open, fair, promote urban construction, housing reform integration progress and development.
