论我国政府购买服务立法的着力点

【摘要】：我国政府购买服务面临制度化难题,法律缺位与不断发展的现实需要间的矛盾日益凸显,有必要从立法层面探讨制度问题的解决。结合公共服务的理论发展和国际立法演变经验,政府购买服务立法应当着力于新公共管理范畴,注重行政管理规制,关注政府核心职能和辅助职能的区分。政府购买服务作为政府采购的一个分支,应当在现有政府采购法律框架下,对购买服务予以细化规制,以实现整个采购法律体系的协调一致。
[Abstract]:Our government is faced with the problem of institutionalization and the contradiction between the absence of law and the developing reality needs is increasingly prominent. It is necessary to discuss the solution of the system problem from the legislative level.Combined with the theoretical development of public services and the evolution of international legislation, the legislation of government purchasing services should focus on the new public management category, pay attention to the administrative regulation, and pay attention to the distinction between the core and auxiliary functions of the government.As a branch of government procurement, government purchasing services should be regulated in detail under the existing legal framework of government procurement in order to achieve the coordination of the entire procurement legal system.
