【摘要】：农村土地不仅仅是农民的安身之本，也是国家的“生命线”，土地具有财产属性和资源属性，决定了土地权利的设定以及土地制度的建构不可避免地具备公私法双重限制。宅基地使用权的流转及其规范同样具备公法与私法的双重性质，因此，宅基地使用权虽是用益物权，但其流转仍然需要国家的适度干预，这样才能更好地维护土地权利人合法权益以及保障国家对土地资源进行公共管理的双重目标。现行宅基地使用权制度安排已经严重束缚了农村社会经济生产力的发展，也违背统筹城乡发展的战略目标，因此，对宅基地使用权流转问题进行系统的研究，具有重要的理论和实践意义，本文通过对宅基地使用权流转的依据、内部结构、方式和变动模式等多个方面的介绍，通过理论及实证双重方式来论证宅基地使用权的流转性，对宅基地使用权流转及其法律规制进行了较为全面、深入的论述。本文的主体共六个部分。第一部分为前言，简述了宅基地使用权的概念、性质、功能等基本法律要素，，为后文研究提供了详实的理论基础。第二部分详述了关于宅基地使用权流转的制度依据及其步完善性，列明了限制其流转的障碍，提出了宅基地在限制中流转这一客观问题。第三部分分析了宅基地在流转中涉及的各类主体，包括宅基地流转过程中各方当事人，集体经济组织的地位以及国家利益保障三个方面，以便于更加深刻的认识宅基地流转的状态。第四部分分析了宅基地使用权流转的内容与客体，通过对权利结构的逐步解析，明确其流转价值，阐明其流转的必要性和必然性。第五部分详细介绍了宅基地使用权流转的原则和方式，并通过二者之间的客观联系，透视其流转的具体状态。第六部分详细研究了宅基地在流转过程中的物权变动模式，从取得、转让、消灭三个方面列明了相关制度的欠缺，从法律角度提出了具体的解决方式。
[Abstract]:Rural land is not only the foundation of farmers' security, but also the "lifeline" of the country. Land has property and resource attributes, which determines the establishment of land rights and the construction of land system, which inevitably has dual restrictions of public and private law. The circulation and regulation of the right to use the homestead also has the dual nature of public law and private law. Therefore, although the right to use the homestead is usufruct, its circulation still needs the moderate intervention of the state. Only in this way can we better safeguard the legal rights and interests of the land owners and ensure the public management of land resources by the state. The current system of homestead use right has seriously restricted the development of social and economic productive forces in rural areas, and is also contrary to the strategic goal of coordinating urban and rural development. Therefore, the circulation of homestead use right has been systematically studied. It has important theoretical and practical significance. Through the introduction of the basis, the internal structure, the way and the mode of change of the right to use the homestead, this paper demonstrates the transference of the right to the use of the homestead through both theoretical and empirical methods. The circulation of homestead use right and its legal regulation are discussed comprehensively and deeply. The main body of this paper consists of six parts. The first part is the preface, briefly describes the concept, nature, function and other basic legal elements of the right to use homestead, which provides a detailed theoretical basis for the later study. The second part elaborates the system basis and its perfection of the circulation of the right to use the homestead, lists the obstacles to restrict the circulation of the homestead, and puts forward the objective problem of the circulation of the homestead in the restriction. The third part analyzes all kinds of subjects involved in the circulation of homestead, including the parties involved in the circulation of homestead, the status of collective economic organizations and the protection of national interests. In order to facilitate a deeper understanding of the status of homestead circulation. The fourth part analyzes the content and object of the transfer of the right to use the homestead, through the gradual analysis of the structure of the right, clear its circulation value, clarify the necessity and inevitability of the circulation. The fifth part introduces the principles and methods of the circulation of the right to use the homestead in detail, and through the objective connection between the two, perspective the specific state of the circulation. The sixth part makes a detailed study of the real right change mode in the process of the homestead circulation, from the acquisition, transfer, elimination of three aspects listed the deficiencies of the relevant system, from the legal point of view to put forward specific solutions.
