我国引咎辞职官员复出制度研究

【摘要】:引咎辞职作为我国政治生活中出现的一个引人注目的新现象,它的实施确实取得了一定的效果:在建设责任政府、塑造政府良好形象、增强官员责任感等方面都产生了积极的效应。但近年来,随着引咎辞职官员不断悄然复出,引咎辞职官员的去向问题逐渐成了公众关注的焦点和公共管理领域的热点问题。 引咎辞职官员复出是引咎辞职制度不可或缺的部分,研究引咎辞职官员复出问题,对促进引咎辞职制度完善和顺利运行,维护政府形象,建设法治政府和责任政应、保障公民知情权、参与权、表达权和监督权具有重要的意义。因此,本文以引咎辞职官员复出为研究对象,通过案例分析,揭示了引咎辞职官员复出过程中存在的问题:复出时间短、复出理由不详、复出过程缺乏透明度、公众参与度低,然后分析造成这些问题的原因:复出的相关法律法规不完善、信息公开不到位、复出跟踪机制的缺失以及复出评价机制欠缺。最后,在结合已有的研究基础上,提出了一些完善引咎辞职官员复出制度的对策。首先,完善复出的相关法律法规,增强其可行性和可操作性;第二,明确复出的条件,包括复出时间、工作业绩等内容;第三,加强信息公开,实现复出过程透明化,提高公众参与度;第四,建立复出跟踪考评机制;第五,建立违规复出责任追究机制;第六,加强复出的社会监督机制建设。本文最后还提到,引咎辞职官员并非官场这一条道路可走,也可以尝试其他职业,如到高校任教、去非营利组织工作等,这样也就不会出现如此之多不规范复出的现象。 本文的创新点在于:第一,提出引咎辞职官员可以复出,但并不等于必然复出,必须满足资格条件和成熟条件。第二,引咎辞职官员的复出程序应与正常的领导干部选拔任用程序有所不同,主要包括复出提议、组织调查与公示、民意测评、复出决定和复出公示这几个环节。
[Abstract]:As a noticeable new phenomenon in the political life of our country, the implementation of blame and resignation has achieved certain results: to build a responsible government, to create a good image of the government, To enhance the sense of responsibility of officials and other aspects have produced a positive effect. However, in recent years, with the resignation of officials quietly come back, the issue of the resignation of officials has gradually become the focus of public attention and the hot issue in the field of public administration. It is an indispensable part of the system of taking the blame and resigning officials to study the problem of the return of the officials who take the blame and resign, which will promote the perfection and smooth operation of the resignation system, safeguard the image of the government, and build a government ruled by law and responsible administration. It is of great significance to protect citizens' right to know, participate, express and supervise. Therefore, this paper takes the reappearance of the officials who take the blame and resignation as the research object, and through the case analysis, reveals the problems existing in the process of reappearance: short time, unknown reason, lack of transparency and low public participation. Then the causes of these problems are analyzed: the related laws and regulations are not perfect, the information is not in place, the lack of follow-up mechanism and the lack of evaluation mechanism. Finally, on the basis of existing research, some countermeasures are put forward to perfect the system of reversion of officials who take the blame and resign. First, improve the relevant laws and regulations, enhance its feasibility and maneuverability; second, clear the conditions, including the return time, work performance and other content; Third, to strengthen the information disclosure, to achieve transparency in the process of re-exit, to improve public participation; fourth, to establish a mechanism for follow-up and evaluation of re-exit; fifthly, to establish a mechanism to investigate the liability for the return of illegal returns; and sixthly, to strengthen the construction of social supervision mechanism. At the end of this paper, it is also mentioned that resigning officials is not an official way to go, but also to try other professions, such as teaching in colleges and universities, working in non-profit organizations, and so on, so that there will not be so many phenomena of irregular comeback. The innovation of this paper lies in the following: first, it is necessary to meet the qualifications and mature conditions, but it does not mean that the officials who take the blame and resign can be returned. Second, the procedures for reinstating officials should be different from the normal procedures for selecting and appointing leading cadres, including proposals for reinstatement, organization of investigation and publicity, public opinion evaluation, decision to return and public announcement.
