【摘要】:针对银行个人理财业务,以现实案例为基础,本文提出了一个基于产品和契约类型差异性的分析银行和客户所应承担义务的框架。产品风险性、收益性(两者都应考虑程度和概率)、流动性(包括期限和提前终止条件)三大要素的匹配程度可用来度量客户风险和收益的不对称性,从而评判银行适当性和告知义务的履行情况。银行与客户间的契约关系差异也很重要,从一次性契约、多次契约到长期契约,客户的审慎义务有所放松;而对于银行适当性、告知义务的要求也应逐渐降低,但信义义务相应增强,审查重点也更多地转向利益冲突的防范。
[Abstract]:The bank personal financial services, based on the actual case, this paper proposes a contract and product type difference analysis based on the bank and the customer should bear obligations of the framework. The product risks, profitability (both of which should be considered and the degree of probability), liquidity (including term and early termination conditions) asymmetry the matching degree of the three factors can be used to measure the risks and benefits of customers, so as to judge the appropriateness and the obligation to inform the bank performance. The contractual relationship between banks and customers is also very important, from a one-time contract to contract, many long-term contracts, careful duty customers have to relax; the bank told adequacy. The compulsory requirements should be gradually reduced, but the fiduciary duty intensified prevention review focus more to conflicts of interest.
