混业经营趋势下我国金融监管协调机制的挑战与革新——法与经济学视角

【摘要】：在跨国金融机构的竞争、示范效应和国内金融机构效率追求的双向驱动下,我国混业经营趋势日渐迅猛,而这对我国现行金融监管协调机制国内、国际两个层面,都带来了新的挑战。2015年6月的股灾,所昭示的证监会和银监会的不协调,更是凸显了当下协调机制改革的迫切需求。本文以法与经济学视角分析了混业经营趋势下我国金融监管协调机制的革新,并通过绩效分析金融监管协调机制方案,得出:在国务院设立金融监管协调委员会,专司三会协调及与人民银行的协调,是较为得当的选择,同时就中国国际金融监管协调机制的制度构建与完善,提出了初步建议。
[Abstract]:Driven by the competition of transnational financial institutions, the demonstration effect and the efficiency pursuit of domestic financial institutions, the trend of mixed operation in our country is increasingly swift and violent, which has two aspects, domestic and international, to the current financial supervision and coordination mechanism of our country. The June 2015 stock market crash, the disharmony between the CSRC and the CBRC, highlights the urgent need for reform of the current coordination mechanism. This paper analyzes the innovation of financial supervision coordination mechanism in China under the trend of mixed operation from the perspective of law and economics, and through the performance analysis of the financial supervision coordination mechanism scheme, draws the following conclusions: set up the financial supervision coordination committee in the State Council. The coordination of the three associations and the coordination with the people's Bank is a more appropriate choice. At the same time, the author puts forward some preliminary suggestions on the establishment and perfection of the coordination mechanism of international financial supervision in China.
