既有建筑拆除行政审批制度研究

【摘要】：随着我国城市化进程的加快,既有建筑随意拆除现象严重,我国大量处于青壮年期的既有建筑提前报废,这造成严重的”建筑短命”现象,同时也是对环境的污染和对资源的极大浪费。针对目前现状本文从行政管理学的角度展开研究,通过对目前我国有关既有建筑行政审批制度的对比和探讨,提出构建面向21世纪的既有建筑拆除行政审批制度,尝试从程序优先的层面构建既有建筑拆除行政审批制度,使其优先于建设工程项目行政审批的其他环节,从审批的源头遏制建筑的大拆大建现象。通过对既有建筑、建筑拆除、建筑拆除行政审批进行定义,从创新既有建筑保护理念、既有建筑拆除行政审批制度内容、管理与服务流程三个方面初步探讨如何构建既有建筑拆除行政审批制度。力图在行政审批制度改革的背景增设全新的关于既有建筑拆除的行政审批环节,完善我国建设工程项目行政审批制度缺位现象。支持中国城市化进程,推动中国社会可持续发展的理想和目标。
[Abstract]:With the acceleration of urbanization in our country, the phenomenon of random demolition of existing buildings is serious, and a large number of existing buildings in the prime of life in our country are abandoned in advance, which results in a serious phenomenon of "short life of buildings".At the same time, it is also the pollution of the environment and a great waste of resources.In view of the present situation, this paper studies from the angle of administrative management, through comparing and discussing the administrative examination and approval system of existing buildings in our country at present, proposes to construct the administrative examination and approval system of demolition of existing buildings facing the 21st century.This paper attempts to construct the administrative examination and approval system for demolition of existing buildings from the aspect of procedure priority, so as to make it take precedence over other links of administrative examination and approval of construction projects, and to curb the phenomenon of large demolition and construction of buildings from the source of examination and approval.Through the definition of the existing building, the demolition of the building, the administrative examination and approval of the demolition of the building, the contents of the administrative examination and approval system for the demolition of the existing building are innovated,This paper discusses how to construct the administrative examination and approval system for demolition of existing buildings from three aspects of management and service flow.In the background of the reform of the administrative examination and approval system, the author tries to add a completely new administrative examination and approval link on the demolition of existing buildings, and perfect the absence of the administrative approval system for construction projects in our country.Support China's urbanization process and promote the ideals and goals of sustainable social development in China.
