藏族习惯法回潮及其原因探析

【摘要】：近年来学界对藏族习惯法的研究主要关注点在于其回潮之后对藏区经济社会发展所产生的实际影响,分析其与国家制定法之间的契合与冲突,在社会转型时期如何通过地方立法吸收其合理成分等方面,而对于其回潮原因深入分析并不多。究其回潮原因,与藏族习惯法的历史惯性、藏区经营方式转变、社会控制减弱、相关国家机关的迁就,以及群众对传统文化的认同心理、国家制定法的相对陌生和相关国家机关执法和司法行为的不完全信任等直接相关。
[Abstract]:In recent years, academic research on Tibetan customary law has mainly focused on the actual impact on the economic and social development of the Tibetan region after its return to the tide, and on the analysis of the compatibility and conflict between it and the national laws.In the period of social transformation, how to absorb its reasonable components through local legislation, but the reasons for its return are not much.The reasons for its comeback are the historical inertia of the Tibetan customary law, the change in the mode of operation in Tibetan areas, the weakening of social control, the accommodation of relevant state organs, and the masses' mentality of identifying with traditional culture.The relative strangeness of the state-made law is directly related to the incomplete trust of the law enforcement and judicial behavior of the relevant state organs.
