广东劳工维权类社会组织生存困境研究

【摘要】：劳工维权类社会组织是在中国特有政治、经济、社会体制环境下催生的,直接并主要为务工人员提供服务的公益性社会组织,它们在维护工人合法权益、化解劳资纠纷、反映工人群体诉求、促进社会和谐稳定等方面发挥重要作用。但从上世纪九十年代诞生至今,该类组织长期处于边缘化状态,绝大多数无法获得合法身份,生存上遇到重重困难,极大地抑制了其所能承担的更多的积极社会作用。目前劳工维权类社会组织的这种情况已经受到学界的关注,然而这些研究都以理论碎片的形式出现,大多是关于劳工维权类社会组织研究中的某个片段,尚未有对劳工维权类社会组织的现状、问题、原因和改革路径进行全面的分析。因此,对劳工维权类社会组织生存困境的研究既具有重大的现实价值,也具有深刻的理论意义。本研究主要采用访谈调研的方法,通过电话、当面等访谈途径,挑选3个政府部门的公职人员及8个劳工维权类社会组织进行深入的实证观察和调研,对劳工维权类社会组织的现状和问题进行了深入分析。研究认为,政府态度谨慎、社会氛围不足、组织管理欠缺是造成劳工维权类社会组织生存困境的主要原因。文章认为,对当前劳工维权类社会组织的改革需要解放思想,转变观念,坚持“宽进严出”的思路,放宽登记注册,加强培育发展和规范管理,综合施策促进劳工维权类社会组织健康发展。
[Abstract]:Labor rights rights social organizations are public welfare social organizations which are born under the special political, economic and social environment of China. They are directly and mainly serve the workers. They play an important role in maintaining the legitimate rights and interests of workers, resolving labor disputes, reflecting the demands of the workers and promoting social harmony and stability. Since the birth of the 90s, this kind of organization has been marginalized for a long time. The vast majority of these organizations have been unable to obtain legal identity and have encountered many difficulties in survival, which greatly inhibit the more active social roles they can undertake. The form of theoretical fragmentation is mostly about a segment in the study of the social organization of labor rights rights. It has not yet made a comprehensive analysis of the status, problems, causes and the path of reform of the labor rights social organizations. Therefore, it is of great practical value and profound significance to the study of the survival predicament of the labor rights social organizations. This study mainly adopts the method of interview and investigation. Through the telephone, interview and other interviews, 3 government departments and 8 labor rights social organizations are selected to conduct in-depth empirical observation and research. The present situation and questions of the labor rights social organizations are deeply analyzed. Prudence, lack of social atmosphere and lack of organization and management are the main reasons for the survival of the labor rights social organizations. The article holds that the reform of the current labor rights social organizations needs to emancipate their minds, change their ideas, adhere to the idea of "wide and strict out", relax the registration, strengthen the cultivation and development and standardize the management, and make comprehensive policies. Promote the healthy development of the labor rights social organizations.
