政府信息依申请公开制度运行问题研究

【摘要】：依申请公开制度作为我国政府信息公开制度的重要组成部分,主要是指行政机关根据公民、法人或者其他组织的申请,在法律规定下,在本机关的职权范围内,按照一定的程序,向申请人公开政府信息的一种制度。与主动公开政府信息相比,依申请公开政府信息更能体现公民的政治参与性和公民知情权的实现程度。可以说,依申请公开制度是我国政府信息公开制度的核心,依申请运行的好与坏也在一定程度上反映了我国透明政府、民主政府和法治政府建设的成效。然而,我国依申请公开的实践仍面临着不少阻力,我国依申请公开制度运行中还存在申请主体受限制、申请渠道不畅通、申请程序不健全、申请答复不理想、申请救济无实效等问题。究其原因,大多在于我国信息公开制度的设计不健全,除此之外,政府信息的管理系统还不尽完善,对信息公开的监督缺乏强有力的保障措施。为此,要想改变这一现状,我国需要对依申请制度进行有针对性的改进。一是增强行政人员的“公开”意识和服务意识,同时提高公民的权利意识。二是完善信息公开的立法工作,弥补法律漏洞。三是加强依申请的队伍建设,分清权责内容,加强培训,转变服务态度。四是优化依申请的信息管理系统,健全政府信息源头管理机制和审查机制,对依申请的技术障碍进行清理和改进。五是建立健全依申请的监督保障机制,不仅要加强内外部监督,还要注重投诉举报系统的整建,进行考核和问责,更重要的是探索建立独立的第三方监管机构。
[Abstract]:As an important part of our government information disclosure system, the system of disclosure according to application mainly refers to the administrative organs, according to the application of citizens, legal persons or other organizations, within the scope of their own organs' functions and powers, as stipulated by law, A system of disclosure of government information to applicants in accordance with certain procedures. Compared with the active disclosure of government information, the application of public government information can better reflect the political participation of citizens and the realization of citizens' right to know. It can be said that the system of disclosure according to application is the core of the open system of government information in our country. The good or bad operation of the application also reflects to a certain extent the effect of the construction of transparent government, democratic government and government ruled by law in our country. However, the practice of making the application public in our country is still faced with many obstacles. In the operation of the open application system, there are still some restrictions on the application subject, the application channel is not smooth, the application procedure is not perfect, and the application reply is not ideal. The application for relief is ineffective and so on. Most of the reasons lie in the imperfect design of information disclosure system in our country. In addition, the management system of government information is not perfect, and the supervision of information disclosure is lack of strong safeguard measures. Therefore, in order to change this situation, China needs to improve the application system. First, to enhance the administrative staff's awareness of "open" and service, while raising the awareness of citizens' rights. Second, perfect the legislation work of information publicity, make up the legal loophole. Third, strengthen the team building according to the application, distinguish the content of power and responsibility, strengthen training, change service attitude. Fourth, we should optimize the information management system based on application, perfect the mechanism of government information source management and review mechanism, and clean up and improve the technical obstacles in accordance with the application. Fifth, to establish and improve the supervision and security mechanism according to the application, not only to strengthen the internal and external supervision, but also to pay attention to the integration of the complaint and report system, to conduct assessment and accountability, and more importantly, to explore the establishment of an independent third-party regulatory body.
