环境冲突事件中的基层政府责任研究

【摘要】：因环境利益冲突而导致的环境冲突事件在我国时有发生,环境冲突事件的发生和解决影响着社会稳定与社会和谐。研判环境冲突事件的生成、处置环境冲突事件中利益各方的关系,都要求政府出场担责。基层政府作为我国政府的一个层级,是联系上级政府和基层群众之间的桥梁,在处置环境冲突事件中起着基础性的作用。因此,明了基层政府在环境冲突事件中的责任,使基层政府在处置环境冲突事件中合理担责,就具有重要的理论价值和实践意义。本文通过对当前环境冲突事件中基层政府的角色定位、责任履行、责任追究进行剖析,在科学理论的指导下,准确定位政府角色,厘清政府职能,建立有效的追责制度,以促进美丽中国建设。本文包括四个部分:第一部分:国内外研究综述。主要的研究内容是建立在建设社会主义生态文明的大背景之下,阐释本研究的选题背景和意义,对国内外关于环境冲突事件的相关研究进行了综述,引出本文研究的重点。第二部分:理论分析。主要界定环境冲突事件、基层政府和政府责任的概念,阐述本文开展研究所依据的政府责任理论、社会冲突理论以及“善治理论”,为本文开展研究夯实其理论基础。第三部分:环境冲突事件事件中基层政府履责的现状分析。主要分析近年来我国典型的环境冲突事件的起因、影响、基层政府履责与追责的现状,总结其经验与教训。第四部分:责任的厘定与追责。主要研究了厘定基层政府在环境冲突事件中的责任的基本依据、基本立场和基层政府应履行的责任,以及基层政府追责的内容与保障机制。
[Abstract]:The environmental conflict events caused by the conflict of environmental interests occur from time to time in our country. The occurrence and solution of the environmental conflict events affect the social stability and social harmony. The study of the occurrence of environmental conflicts and the handling of the relationship between the parties involved in environmental conflicts require the government to be held accountable. As a level of our government, the grass-roots government is a bridge between the superior government and the grassroots people, and plays a fundamental role in dealing with environmental conflicts. Therefore, it is of great theoretical value and practical significance to understand the responsibility of grass-roots governments in environmental conflicts and to make them reasonably responsible in dealing with environmental conflicts. Based on the analysis of the role, responsibility and accountability of the grass-roots government in the current environmental conflict, under the guidance of scientific theory, this paper accurately locates the role of the government, clarifies the functions of the government, and establishes an effective accountability system. To promote the construction of beautiful China. This paper includes four parts: the first part: domestic and foreign research review. The main research content is based on the background of building socialist ecological civilization, explains the background and significance of this study, summarizes the related research on environmental conflict events at home and abroad, and leads to the focus of this study. The second part: theoretical analysis. This paper mainly defines the concept of environmental conflict event, grass-roots government and government responsibility, and expounds the theory of government responsibility, social conflict theory and "good governance theory", which is the basis of the research in this paper. The third part: the current situation analysis of the basic level government's responsibility in the environmental conflict event. This paper mainly analyzes the causes and effects of typical environmental conflicts in recent years, the present situation of the basic government's responsibility and accountability, and summarizes its experiences and lessons. Part IV: responsibility determination and accountability. This paper mainly studies the basic basis of determining the responsibility of the grass-roots government in the environmental conflict, the basic stand, the responsibility that the grass-roots government should perform, and the content and the safeguard mechanism of the responsibility of the grass-roots government.
