上海自贸区行政审批负面清单制度发展问题研究

【摘要】:现代社会各国政治、经济联系日益密切,外商投资在我国已经成为经济发展不容忽视的重要组成部分。我国在对待外商投资准入方面一直以来都是使用的行政审批正面清单制度。随着我国综合国力的不断提升,其国际影响力越来越大,因此我国需要在国际贸易投资平台上找到自身的位置。为了与国际规则接轨,实施行政审批负面清单制度显然势在必行。2013年上海自贸区首次推出行政审批负面清单制度以来,在行政审批负面清单内容中明确将禁止和限制的行业类别以清单的形式公开标注。它能够让投资者对市场准入标准有一个清晰的认识,进而能够使企业依法准入市场。这样不仅节省了审批的时间也为外资准入提供了一个良好的平台。行政审批负面清单制度实施的几年来,国家取得了一定成效,政府职能得到了切实转变。可见行政审批负面清单制度的实施不管是在经济上还是在行政审批制度改革上都具有积极作用。由传统的审批制到现在的备案制、注重事前审批到转为事中事后监管的制度创新,上海自贸区负面清单制度发展取得的巨大成效让我们看到了提高政府行政效率的有效途径,也给我们的生活带来了巨大的改变。政府将首个自贸区建立在上海并非是偶然的,这是由上海本身所具有的良好基础设施和外贸条件所决定的。在此基础上,政府又出台了与负面清单制度相适应的相关政策以辅助其发展,从而进一步缩减行政审批程序,提高工作效率,实现政府职能真正意义上的转变。当然,上海自贸区作为首个尝试负面清单制度的自贸区,在其发展的过程中也避免不了会遇到问题和挑战。本文首先是对行政审批和负面清单的概念进行全面梳理,总结自贸区实施负面清单制度以来的成果与经验,以服务型政府理念和整体性政府理论对深化上海自贸区负面清单制度存在的现实问题进行论述,进而提出操作性较强的有效对策。
[Abstract]:Foreign investment has become an important part of economic development in China. The positive list system of administrative examination and approval has always been used in the treatment of foreign investment access in our country. With the continuous improvement of China's comprehensive national strength, its international influence is increasing, so China needs to find its own position on the platform of international trade and investment. In order to be in line with international rules, it is obviously imperative to implement the system of negative lists of administrative examination and approval. Since 2013, when the Shanghai Free Trade Zone first launched the system of negative lists of administrative examination and approval, The prohibited and restricted industry categories are clearly marked in the form of lists in the negative list of administrative approval. It can give investors a clear understanding of market access standards, and then enable enterprises to enter the market according to law. This not only saves the time of examination and approval, but also provides a good platform for foreign investment access. In the years since the implementation of the negative list system of administrative examination and approval, the government has made some achievements and government functions have been changed. It can be seen that the implementation of the negative list system of administrative examination and approval plays a positive role both economically and in the reform of the administrative examination and approval system. From the traditional examination and approval system to the present record system, we have paid attention to the institutional innovation from prior examination and approval to post-event supervision. The tremendous results achieved in the development of the negative list system of the Shanghai Free Trade Zone have enabled us to see an effective way to improve the administrative efficiency of the government. It has also brought about great changes in our lives. It is no accident that the government established the first free trade zone in Shanghai, which is determined by its own good infrastructure and foreign trade conditions. On this basis, the government has issued relevant policies adapted to the negative list system to assist its development, so as to further reduce the administrative examination and approval procedures, improve work efficiency, and realize the real transformation of government functions. Of course, as the first free trade zone to try the negative list system, the Shanghai Free Trade Zone can not avoid the problems and challenges in its development. The first part of this paper is to comb the concepts of administrative examination and approval and negative list, and summarize the achievements and experiences since the implementation of the negative list system in the Free Trade area. Based on the concept of service-oriented government and the theory of holistic government, this paper discusses the practical problems existing in deepening the negative list system of Shanghai Free Trade area, and then puts forward some effective countermeasures with strong maneuverability.
