行政伦理视角下规范公务员行政行为探析

【摘要】:政府的公共事务都是由公职人员来贯彻实施的,人民赋予公务员权力是为了享受更好的服务,因此这就要求行政领域内的工作人员是具有高尚品格的人,必须有较高的道德情操,并遵守规范,将服务于公众的理念贯穿于整个职业生涯之中,这便是行政伦理的核心要求。为了服务政府、责任政府的构建,健全公务员的行政人格,化解公务员的伦理困境,笔者通过对行政伦理视角下行政人员行为的现状分析,探究其原因并提出解决对策。本文由五部分组成,第一部分从行政伦理选题的背景和意义谈起,叙述了从现实和理论方面关注行政伦理失范的意义,本部分列举了国内学者和国外学者对该方面的研究,提出将使用的研究方法以及文章可能的创新之处。第二部分从行政、行政伦理、行政行为的概念入手,阐述了公共行政行为与行政伦理规范的契合点,接着论述公民精神、马斯洛需求层次理论、“公共人”假设三个基础理论,希望为论文的撰写提供理论依据和方向。第三部分为我国公务员行政行为的伦理冲突解析,文章从现实案例出发,通过对不同案例的剖析,分别对公共权力与组织权力的冲突;公共角色、组织角色和家庭角色的冲突;公私利益的冲突进行了分析。第四部分为我国公务员行政行为失范的原因,包含行政伦理体系的不规范,行政文化的缺失以及行政环境的影响。从行政伦理立法的不完善到行政伦理监督的缺位再到行政人员的选拔漏洞,以及受传统行政文化的影响和现代文化的禁锢,还有行政环境的影响等方面做了详细论述。文章的最后一部分则是核心段落,笔者在深入分析我国公务员伦理失范现状和原因的基础上,重点分析了有关部门在公务员行政伦理培训教育、行政伦理立法、行政体制改革、行政伦理监督以及行政伦理文化建设方面可采取的措施,也借鉴了先进国家的行政伦理体系建设经验,希望能够给我国行政伦理的建设提出可行性的意见,使我们国家的行政伦理得到完善,更好的打造服务型政府。
[Abstract]:The public affairs of the government are carried out by public officials, and the people empower the civil servants to enjoy better service, so this requires that the staff in the administrative field are people of high moral character. It is the core requirement of administrative ethics that we must have a higher moral sentiment, abide by the norms, and run through the whole career with the idea of serving the public. In order to serve the government, construct the responsible government, perfect the administrative personality of the civil servants and resolve the ethical dilemma of the civil servants, the author analyzes the present situation of the administrative staff behavior from the perspective of administrative ethics, probes into its causes and puts forward some countermeasures. This paper is composed of five parts. The first part begins with the background and significance of selecting administrative ethics topics, narrates the significance of paying attention to administrative ethics anomie in practical and theoretical aspects, and enumerates the research on this aspect by domestic and foreign scholars. The research methods to be used and the possible innovations of the article are proposed. The second part begins with the concepts of administration, administrative ethics and administrative behavior, and expounds the common point between public administrative behavior and administrative ethical norms, and then discusses three basic theories: citizen spirit, Maslow's hierarchy of needs theory, and "public man" hypothesis. Hope to provide theoretical basis and direction for the writing of the paper. The third part is the analysis of the ethical conflict of civil servants' administrative behavior in our country. The article analyzes the conflict of public power and organizational power, the conflict of public role, organization role and family role respectively through the analysis of different cases. The conflict of public and private interests is analyzed. The fourth part is the causes of administrative misconduct of civil servants in China, including the non-standard administrative ethics system, the lack of administrative culture and the influence of administrative environment. From the imperfection of administrative ethics legislation to the absence of administrative ethics supervision to the loopholes in the selection of administrative personnel, the influences of traditional administrative culture and modern culture, as well as the influence of administrative environment, are discussed in detail. The last part of the article is the core paragraph. On the basis of in-depth analysis of the present situation and causes of civil servants' ethical anomie in China, the author focuses on the relevant departments in the education of civil servants' administrative ethics training, administrative ethics legislation, and the reform of the administrative system. The measures that can be taken in the supervision of administrative ethics and the construction of administrative ethics culture also draw lessons from the experience of the construction of administrative ethics system in advanced countries, and hope to put forward some feasible suggestions for the construction of administrative ethics in our country. So that our country's administrative ethics has been improved, a better service-oriented government.
