行政问责的困境与出路:基于双外部性的分析视角

【摘要】：行政问责在理论上和实践上一直受到较大关注,但是却仍然存在着局限性。表现为行政问责是基于治理对象和权力边界的双外部性的问责。治理对象的外部性难以有效确定被问责对象,造成问责不精准的问题;权力边界的外部性难以有效规范问责者的行为,导致有问题不问责的现象。这种双外部性限制了行政问责的效度,不能够起到对权力的制约和监督以及规范行政行为的作用。研究表明,克服双外部性带来的这些局限,需要分清问责主次,合理配置共同责任的问责;推行权力清单制以明晰政府的具体职责权限;细化问责文本,约束问责者行为;吸纳公众参与,回应社会质疑。这些对双外部性的矫正可以促进依法行政,构建责任政府,更好地发挥行政问责的作用。
[Abstract]:Administrative accountability has been paid more attention in theory and practice, but it still has its limitations. Administrative accountability is based on the dual externalities of governance object and power boundary. The externality of the governance object is difficult to determine the accountable object effectively, resulting in the problem of imprecise accountability; the externality of the power boundary is difficult to regulate the behavior of the accountable person effectively, which leads to the phenomenon of no accountability. This dual externality limits the validity of administrative accountability and cannot restrict and supervise power and standardize administrative behavior. The research shows that to overcome these limitations brought by dual externalities, we need to distinguish accountability priorities, reasonably allocate the accountability of joint responsibility, implement the power list system to clarify the specific responsibilities of the government, refine the accountability text, and restrict the behavior of accountability. To engage the public and respond to social queries. These correction of dual externalities can promote administration according to law, construct responsible government, and play a better role in administrative accountability.
