反思与突破:公共事务可治理性研究

【摘要】:改革开放是一次全方位的变革,社会主义市场经济发展为社会主体意识的形成和社会力量的成长提供了现实基础,也直接为公共事务治理结构的变迁提供契机。学术界关于治理话语的引介及其适用性的讨论加速了这一过程。与之对应,政府治理的方式、理念更加多元和创新,本土化可治理性发展趋向的探索已然开启。在此基础上,公共事务治理是多主体的互动过程,这一过程所要解决的关键问题是公共事务治理行动是如何被组织起来的,即治理者如何协调多个参与者以达成共识和集体行动,并通过有效的政策制定与实施来分配资源、化解冲突,从而实现维护社会秩序、解决社会问题或向社会公众提供公共服务等目的。由于问题叠加显现,国内可治理性问题更多表现在现有行政体制安排及其缺陷同社会治理力量的发展之间的张力不利于治理转型,社会主体公共性的匮乏使得在相互信任的基础上,经由互惠性交往促进合作治理的达成存在诸多变数。此外,国家与社会之间互动的制度化渠道也并未相应建立起来。现行的治理模式更多指向一种多元治理主体的组合,其静态外观大于动态结果,在行政活动的惯性作用下呈现出体制内权力主体对体制外社会资源的全方位吸纳特征,在其运作过程中需要强化制度规范和法治约束。在系统思考公共事务治理的历史背景、现实问题、生成逻辑和发展趋向的基础上,如何实现国家治理、政府治理与社会治理之间的彼此借力、相向而行,既要求宏观层面的制度设计和价值引领,又要求细化治理运行机制。以问题意识为出发点,建构多元主体合作共治的治理共同体,着力夯实社区治理的现实基础,保障社会力量的基本权益是国内公共事务可治理性发展的基本途径。
[Abstract]:Reform and opening up is an all-around reform. The development of socialist market economy provides a realistic basis for the formation of social subjective consciousness and the growth of social forces, and also provides an opportunity for the change of the governance structure of public affairs. The discussion on the introduction and applicability of governance discourse accelerates the process. Correspondingly, the mode and concept of government governance are more diversified and innovative, and the exploration of the localization of governable rational development trend has already begun. On this basis, public affairs governance is an interactive process of multi-agents. The key problem to be solved in this process is how the public affairs governance actions are organized. That is, how governance can coordinate multiple actors to reach consensus and collective action, allocate resources and resolve conflicts through effective policy formulation and implementation, thus achieving social order. The purpose of solving social problems or providing public services to the public. Due to the superposition of the problems, the domestic justiciability problems are more often reflected in the tension between the existing administrative system arrangements and their defects and the development of social governance forces, which is not conducive to the transformation of governance. The lack of public nature of social subject makes there are many variables on the basis of mutual trust to promote cooperative governance through reciprocal communication. In addition, the institutionalization of the interaction between the state and society has not been established accordingly. The current governance mode more points to a combination of multiple governance subjects, whose static appearance is larger than the dynamic result. Under the inertia of administrative activities, it presents the characteristics of the omnidirectional absorption of social resources outside the system by the power subject within the system. In the course of its operation, it is necessary to strengthen institutional norms and rule of law constraints. On the basis of systematic consideration of the historical background, realistic problems, generative logic and development trend of public affairs governance, how to realize national governance, government governance and social governance, It not only requires macro-level system design and value guidance, but also requires refinement of governance operation mechanism. Based on the problem consciousness, it is the basic way for the rational development of domestic public affairs to construct the governance community of multi-subject cooperation and co-rule, to strengthen the realistic foundation of community governance and to protect the basic rights and interests of social forces.
