公立高校内部规章制度的法理追问

【摘要】：作为公立高校与学生管理的联结点,高校内部规章制度的研究具有重要意义。公立高校与学生之间既不是简单的民事关系,又不是普通的行政法律关系。国家授权是公立高校制定内部规章制度的主要依据。把公立高校内部规章制度定位于抽象行政行为和自治规章,更有利于学校管理和校生纠纷的解决。主体合法、内容合法、程序合法,符合这三个条件的内部规章制度才具有效力。
[Abstract]:As the connection point between public colleges and students management, the research on the internal rules and regulations of colleges and universities is of great significance. The relationship between public colleges and students is neither a simple civil relationship nor an ordinary administrative legal relationship. State authorization is the main basis for public colleges and universities to formulate internal rules and regulations. The internal rules and regulations of public colleges and universities are oriented to abstract administrative acts and autonomous regulations, which is more conducive to school management and the settlement of disputes among school students. The internal rules and regulations that meet these three conditions are effective only if the subject is legal, the content is legal and the procedure is legal.
