基于依法治校的高校学生事务管理研究

【摘要】：学生事务管理作为高等教育管理的中心环节之一，其核心在于为学生提供良好的学习生活环境，为学生的全面发展提供服务，同时维持正常的校园秩序，使教学活动得以顺利开展。现代学生事务管理体系的突出特点是科学化、专业化和法制化。学生事务管理应当在法律规范的保障和引导下进行，通过合法的手段解决学生事务管理中出现的矛盾和问题，不仅可以提高我国学生事务管理水平和效率，同时也符合我国的“依法治校”方针。建立完善的法律保障体系，可以使学校行为从法律上获得支持，也可以使学生得到国家法律保障，获得司法救济，维护自身权利，提高学生的公民意识。我国高校改革正在稳步推进，学生事务管理工作正在经历一场巨大的变革，在改革进程中，很多矛盾日益凸显，引起了研究者对学生事务管理问题的广泛关注。 “以学生为本”和“依法治校”是党中央、国务院提出的学生事务管理理念，这种理念要求将学生事务管理工作必须以学生为中心，依法治校，通过高校灵活的工作方式和多样化、现代化的教育手段，将发挥学生的主体作用与高校自身的教育、管理、服务职能有机结合，从而促进学生的全面发展。为了实现这一目标，不但需要学生事务管理者转变思想，改变自身的角色定位，同时在制度上，需要建立一个简单、高效、法治化的管理模式，，从根本上消除制约我国学生事务管理发展的各种障碍。本文共包含六个部分，第一部分为引言，是对研究背景、现状、意义、技术路线、创新点的说明；第二部分对“依法治校”和学生事务管理的概念进行了界定，对两者的关系进行分析，为研究提供理论基础；第三部分是对我国学生事务管理现状的分析，找出存在的问题；第四部分是美国学生事务管理法治化保障的分析，并与我国学生事务管理进行对比；第五部分是对建立新型学生事务管理模式的探索性研究；第六部分为研究结论与建议。本文的创新点在于从法治化角度对学生事务管理模式的分析，找出我国学生事务管理存在的问题，分析问题，提出对策，建立新型的学生事务管理模式。
[Abstract]:As one of the central links of higher education management, the core of student affairs management is to provide students with a good learning and living environment, to provide services for the all-round development of students, and at the same time to maintain a normal campus order. So that the teaching activities can be carried out smoothly. The outstanding characteristics of modern student affairs management system are scientization, specialization and legalization. The management of student affairs should be carried out under the protection and guidance of legal norms, and the contradictions and problems in student affairs management should be solved by legal means, which can not only improve the level and efficiency of student affairs management in our country. At the same time, it is also in line with the principle of "administering the school according to law" in our country. The establishment of a perfect legal guarantee system can enable school behavior to be supported by law, as well as students to obtain national legal protection, obtain judicial relief, safeguard their own rights and improve students' civic awareness. The reform of colleges and universities in our country is advancing steadily, and the management of student affairs is undergoing a great change. In the process of reform, many contradictions have become increasingly prominent, which has aroused widespread concern of researchers on the management of student affairs. "Student-oriented" and "running the school according to law" are the concepts of student affairs management put forward by the CPC Central Committee and the State Council. This concept requires that the management of student affairs must be student-centered and run the school according to law. Through the flexible working methods and diversified and modern educational means of colleges and universities, the main role of students will be combined with the education, management and service functions of colleges and universities, so as to promote the all-round development of students. In order to achieve this goal, it is not only necessary for student affairs managers to change their thinking and role orientation, but also to establish a simple, efficient and legalized management model in the system. Fundamentally eliminate all kinds of obstacles that restrict the development of student affairs management in our country. This paper consists of six parts, the first part is the introduction, which is an explanation of the research background, present situation, significance, technical route and innovation. The second part defines the concepts of "running schools according to law" and student affairs management, analyzes the relationship between them, and provides a theoretical basis for the research. The third part is the analysis of the present situation of student affairs management in our country, and finds out the existing problems. The fourth part is the analysis of the legal guarantee of student affairs management in the United States, and compared with the student affairs management in our country; the fifth part is the exploratory research on the establishment of a new student affairs management model; the sixth part is the research conclusions and suggestions. The innovation of this paper lies in the analysis of the management mode of student affairs from the perspective of rule of law, finds out the problems existing in the management of student affairs in our country, analyzes the problems, puts forward some countermeasures, and establishes a new type of management mode of student affairs.
