我国天然橡胶产业生态保护法律制度研究

【摘要】：天然橡胶产业包括种植、加工及废旧橡胶回收利用三个方面。天然橡胶作为支撑我国经济发展的四大工业原料之一,其产量增长带来巨大经济利益的同时还将为国防安全提供保障。天然橡胶的重要性决定了其本应受到更多更全面的关注及保护。但,实际的情况却是,学术界对天然橡胶的经济方面研究繁荣,而生态保护方面研究萧条。我国天然橡胶产业面临严重的生态问题,生态保护现状堪忧。虽然不乏与天然橡胶产业生态保护相关的法律制度,但难以形成体系。客观上存在着天然橡胶种植的专门性规定不完善、对毁林植胶行为的处罚力度不够、缺乏绿色补贴制度、加工企业环境准入标准贯彻执行不力、废水处理创新机制不完善、空气污染联防联控机制不完善、空气污染处罚机制执行不力、废旧橡胶回收利用无法律规制、废旧橡胶利用赋税过重、废旧橡胶回收利用政府监管机制不力等问题。天然橡胶产业中的生态问题,呼吁建立和完善其相关的生态保护法律制度。文章从天然橡胶产业现时存在的生态问题及其生态保护立法现状着手,深入分析总结出天然橡胶产业生态保护制度所存在的问题,并结合国外天然橡胶生态保护制度的优秀成果,进而提出完善天然橡胶种植的专门性规定、完善毁林植胶行为处罚机制、建立天然橡胶绿色补贴机制、建立替代性资源研发应用制度、严格执行加工企业环境准入标准、建立废水处理循环利用机制、完善空气污染联防联控机制、制定《废旧橡胶回收利用管理条例》、完善废旧橡胶回收利用赋税制度和补贴制度、建立废旧橡胶研发循环利用机制等相关方面的建议。
[Abstract]:Natural rubber industry includes planting, processing and recycling of waste rubber. Natural rubber is one of the four major industrial raw materials to support the economic development of our country. The increase of its output will bring huge economic benefits and will also provide security for national defense. The importance of natural rubber determines that it should receive more and more comprehensive attention and protection. But the reality is that academic research on the economic aspects of natural rubber has boomed, while ecological conservation has been depressed. China's natural rubber industry is faced with serious ecological problems, ecological protection situation is worrying. Although there is no lack of natural rubber industry ecological protection related to the legal system, but difficult to form a system. Objectively, there are imperfect regulations on the cultivation of natural rubber, inadequate punishment for planting rubber in deforestation, lack of green subsidy system, weak implementation of environmental access standards in processing enterprises, and imperfect innovative mechanism of wastewater treatment. The air pollution joint control mechanism is not perfect, the air pollution punishment mechanism is weak, the recovery and utilization of waste rubber is not regulated by law, the tax on waste rubber utilization is excessive, the government supervision mechanism of waste rubber recovery and utilization is weak, and so on. Ecological problems in the natural rubber industry call for the establishment and improvement of its related ecological protection legal system. Based on the ecological problems existing in the natural rubber industry and the current situation of the ecological protection legislation, this paper analyzes and summarizes the problems existing in the ecological protection system of the natural rubber industry. Combining with the outstanding achievements of foreign natural rubber ecological protection system, the paper puts forward to perfect the special regulation of natural rubber planting, perfect the punishment mechanism of destroying forest planting gum, and establish the green subsidy mechanism of natural rubber. To establish a system for the development and application of alternative resources, strictly enforce the environmental access standards of processing enterprises, establish a mechanism for recycling waste water treatment and utilization, and improve the joint air pollution prevention and control mechanism, It is suggested to formulate the regulations on waste Rubber Recycling and Utilization, perfect the tax system and subsidy system of waste Rubber Recycling, and establish the Mechanism of R & D Recycling and Utilization of waste Rubber and so on.
