对服务外包中知识产权保护问题的研究

【摘要】：全球产业结构正在进行调整,服务业转移与服务外包的浪潮引领了新一轮的国际产业转移。从发展的历程与趋势看,服务外包这种发包方将其涉及的服务业务以商业形式发包给本企业以外的接包方的经济活动会成为全球经济发展的重要引擎。服务外包产业所具有的调整经济结构、快速拉动经济增长等特点,决定了其作为经济新增长点的地位。大力发展服务外包对缓解就业压力,带动经济发展,促进人才培养,优化产业结构等具有重要意义。中国的服务外包经过最近几年的快速发展,取得了不错的成绩,但同时我国服务外包领域也出现了一些不容忽视的问题。其中,知识产权保护问题对服务外包的发展产生了十分重要的影响。本文清晰地界定了服务外包中的知识产权,利用新经济增长理论、国际贸易理论、国际投资理论、跨国公司理论分析了服务外包中涉及的知识产权问题,尽可能利用相关理论与实证结果,对服务外包中的知识产权问题从理论上进行较为系统的梳理。本文对我国服务外包中知识产权的现状进行了说明,并分析了我国服务外包知识产权存在的管理问题、归属问题以及商业秘密及核心技术泄露问题。中国与印度在经济基础、发展要求、人口情况等方面都很相似,并在服务外包方面的共性极大。因此对中印两国在服务外包的知识产权保护方面的比较很有意义。本文在产权联盟的量化评定与统计结果的基础上进行对比分析。尝试从法律状况、行业协会作用以及保护意识的角度,探究差距产生的内在原因。希望我们正视差距并从中产生更多的思考,通过获得的启示不断完善自身对于服务外包以及其他方面知识产权的保护。
[Abstract]:The global industrial structure is being adjusted, and the tide of service industry transfer and service outsourcing leads to a new round of international industrial transfer. From the perspective of the development process and trend, the economic activities of service outsourcing, which is contracted out to the contractor outside the enterprise in the form of business, will become an important engine of global economic development. The service outsourcing industry has the characteristics of adjusting the economic structure and pulling the economic growth rapidly, which determines its position as the new economic growth point. It is of great significance to develop service outsourcing to relieve the pressure of employment, to promote economic development, to promote the cultivation of talents and to optimize the industrial structure. After rapid development in recent years, China's service outsourcing has achieved good results, but at the same time, there are some problems that can not be ignored in the field of service outsourcing in China. Among them, intellectual property protection has a very important impact on the development of service outsourcing. This paper clearly defines the intellectual property rights in the service outsourcing, analyzes the intellectual property issues involved in the service outsourcing by using the new economic growth theory, the international trade theory, the international investment theory, and the transnational corporation theory. Using the relevant theory and empirical results as far as possible, the intellectual property rights problem in service outsourcing is systematically combed theoretically. In this paper, the current situation of intellectual property rights in service outsourcing in China is explained, and the problems of management, attribution and leakage of trade secrets and core technologies are analyzed. China and India are very similar in terms of economic base, development requirements, population situation and so on, and have great commonality in service outsourcing. Therefore, China and India in the service outsourcing of intellectual property protection is very meaningful. This paper makes a comparative analysis on the quantitative evaluation and statistical results of the property right alliance. This paper attempts to explore the internal causes of the gap from the perspective of legal status, the role of trade associations and the awareness of protection. Hope that we face the gap and produce more thinking, through the inspiration to constantly improve their own services outsourcing and other aspects of intellectual property protection.
