建设工程施工合同管理及索赔问题的研究

【摘要】：作者从我国工程建设施工合同管理的历史背景入手,研究了建设工程施工合同管理与索赔工作的国内外现状,并进一步的进行了分析和探讨,在查阅相关工程资料与调研的过程中,运用了调查研究、数据统计、分析研究及归纳类比等方法,发现了我国合同管理以及工程索赔工作的一些问题,其中具体包括:合同执行力低,无法很好的约束合同当事人;工程竣工结算书及审计资料中无索赔资料的体现;索赔的费用往往以签证与变更单的形式出现;工期的索赔不受重视;反索赔现象几乎为零等内容。所以作者总结出了我国目前建设工程施工合同管理的水平不高,工程索赔管理工作也不能有效的进行。针对这些问题,分别对建设工程施工合同与合同中的索赔管理工作进行了详细的探讨研究。首先从合同的本质和内涵出发研究了合同订立、履行及解除等相关内容。然后深入到我国的建设工程施工合同,讲述了施工合同的本质及其研究内容,从中发现了施工合同管理工作对于工程项目建设有保证合同的合法性、规范性;减少合同违约与合同纠纷的发生;保证工程建设项目的顺利实施等作用。并分别从发包商与承包商的角度探讨研究了如何做好施工合同管理工作,从中发现合同的管理工作不仅是合同实施过程中的管理,更应该从合同签订前加强有关合同管理的相关工作,以确保合同管理有一个良好的开端,进而保证合同的顺利实施,最终以实现工程建设预期目标为目的。在合同管理研究的基础上,作者又对合同管理中索赔管理的内容进行了详细的研究。作者发现索赔管理工作是合同管理工作的核心内容。所以作者从索赔的定义入手,研究索赔管理的相关程序、步骤以及计价方式,找出索赔管理的现实意义。作者通过研究发现索赔管理水平的高低决定这合同管理水平的高低,并且索赔要求的成功率不仅能给企业带来经济利益,还能够极大的促进合同管理工作的深入研究。从索赔研究中,作者还发现反索赔对于工程合同管理也具有同样重要的意义,成功的反索赔必然会促进索赔管理水平的提高,进而提高合同管理水平,最终是整个建筑业的合同管理水平整体提升。最后,本文针对于国内施工合同管理与索赔工作中出现的问题,经过仔细的探讨研究提出了自己的一些看法及建议。希望能对建设工程施工合同管理与索赔工作有所帮助。
[Abstract]:Starting from the historical background of construction contract management in our country, the author studies the current situation of construction contract management and claims at home and abroad, and makes further analysis and discussion. In the process of consulting relevant engineering materials and investigation, we have found some problems in contract management and project claim work in our country by means of investigation and research, data statistics, analysis and research, induction and analogy, etc. Including: low execution of the contract, unable to bind the parties to the contract; the completion of the project settlement statement and audit materials are not reflected in the claim information; the cost of the claim often appears in the form of visas and change orders; No attention is paid to the claim of time limit, and the phenomenon of counterclaim is almost zero. Therefore, the author concludes that the level of construction contract management is not high, and the project claim management can not be carried out effectively. In order to solve these problems, the construction contract and claim management in construction project are studied in detail. First of all, from the essence and connotation of the contract to study the contract conclusion, performance and rescission and other related content. Then it goes deep into the construction contract of our country, narrates the essence of the construction contract and its research content, and finds out that the construction contract management can guarantee the legality and standardization of the contract for the construction of the project. Reduce contract breach and contract disputes, ensure the smooth implementation of construction projects and so on. From the point of view of the contractor and the contractor, this paper discusses how to do the construction contract management well, and finds out that the contract management is not only the management in the process of contract implementation, but also the contract management. It is necessary to strengthen the relevant work of contract management before the signing of the contract to ensure that the contract management has a good beginning, and then to ensure the smooth implementation of the contract, with the ultimate goal of achieving the expected goal of the project construction. Based on the research of contract management, the author makes a detailed study on the content of claim management in contract management. The author finds that claim management is the core of contract management. So the author starts with the definition of claim, studies the procedure, steps and valuation methods of claim management, and finds out the practical significance of claim management. The author finds that the level of claim management determines the level of contract management, and the success rate of claims can not only bring economic benefits to enterprises, but also greatly promote the in-depth study of contract management. From the research of claim, the author also finds that counterclaim is of equal importance to engineering contract management, and successful counterclaim will certainly promote the improvement of claim management level, and then improve the level of contract management. Finally, the overall level of contract management of the entire construction industry has been improved. Finally, aiming at the problems in the management of domestic construction contract and claims, this paper puts forward some opinions and suggestions after careful study. Hope to be able to construction project construction contract management and claim for help.
