扬州市古城保护改造中的划拨土地供应及管理问题研究

【摘要】：拥有2500年历史的古城扬州,1982年被国务院公布为首批国家级历史文化名城,文化底蕴丰厚,历史文物资源丰富。通过实施古城保护改造,发掘和充分利用历史文化资源,既有利于提升古城文化韵味和活力,也有利于带动城市经济社会更好更快发展。发挥土地要素的支撑和保障作用,合理规范使用土地,对于促进古城保护改造走上良性发展轨道有着十分重要的意义。土地划拨是我国现行的基本供地方式之一,杨州市古城保护改造项目建设一直实行划拨方式供地,但由于划拨用地制度仍不完善、配套管理机制尚不健全,古城保护改造项目在土地利用方面仍存在着许多问题和冲突,对古城保护改造项目的顺利实施造成了重要影响。本文首先对划拨用地的概念、范围、相关热点问题研究成果进行了阐述,并对古城保护改造政策及扬州市古城保护改造有关情况做了介绍;其次,作者根据工作实践体会对扬州市古城保护用地及管理现状进行分析,并结合典型案例,指出了扬州古城保护改造用地中存在的划拨供地依据不足、改用用途问题突出、划拨用地资产管理缺失、土地资产盘活难、节约集约用地程度不高等问题,同时揭示了古城保护改造面临的公益性与私益性、文物保护与商业开发、文保资产盘活与划拨用地政策限制之间的冲突;再次,作者从政策层面、政府管理层面、企业层面等多个角度深刻分析上述问题产生的根源,并选取在古城保护改造方面与扬州存在差异的成都和西安进行了用地模式对比分析;最后,针对前述问题与矛盾,作者从完善土地供应和管理政策、转变古城保护改造用地取得和利用方式等方面,提出了建立划拨目录"负面清单"、"相对净地"出让等一系列创新性的政策建议。
[Abstract]:Yangzhou, an ancient city with a history of 2500 years, was declared by the State Council as the first batch of state-level historical and cultural cities in 1982. By carrying out the protection and transformation of the ancient city, exploring and making full use of the historical and cultural resources, it is not only helpful to promote the charm and vitality of the ancient city culture, but also conducive to the better and faster development of the urban economy and society. It is of great significance to give full play to the support and guarantee of land elements and to regulate the use of land reasonably for promoting the protection and transformation of the ancient city on the track of benign development. The allocation of land is one of the basic ways of land supply in our country. The construction of Yangzhou ancient city protection and transformation project has been carrying out the allocation of land, but because the system of allocation of land is still not perfect, the supporting management mechanism is not perfect. There are still many problems and conflicts in the land use of the ancient city conservation and reconstruction project, which has an important impact on the smooth implementation of the ancient city protection and reconstruction project. In this paper, the concept, scope and related hot issues of the allocation of land are first expounded, and the protection and transformation policy of ancient city and Yangzhou city protection and renovation are introduced; secondly, According to the working experience, the author analyzes the present situation of the protected land and management in Yangzhou ancient city, and points out the deficiency of the allocation of land for the protection and transformation of Yangzhou ancient city, and the problem of using it. At the same time, it reveals the public welfare and private interest, cultural relic protection and commercial development faced by the conservation and transformation of the ancient city, such as the lack of management of the allocated land, the difficulty of activating the land assets, the low degree of saving and intensive land use, and so on. Thirdly, the author deeply analyzes the causes of the above problems from the aspects of policy, government management, enterprise and so on. And the author chooses Chengdu and Xi'an, which are different from Yangzhou in the protection and transformation of the ancient city, to make a comparative analysis of the land use patterns. Finally, aiming at the above problems and contradictions, the author tries to improve the land supply and management policy. In this paper, the author puts forward a series of innovative policy suggestions, such as establishing "negative list" of allocation catalogue, "relative net land" transfer and so on.
