我国城镇化进程中失地农民权益保障研究

【摘要】：城镇化是经济社会发展的必然趋势。作为一个国家实现工业化、现代化的必然选择，城镇化是每个国家在实现工业化、现代化过程中所必然和必须经历的一种社会变迁，也是实现农村工业化、农业现代化的必由之路。中国的城镇化进程具有鲜明而独特的中国色彩。改革开放以来大规模城镇化进程恰逢中国计划经济体制走向终结和社会主义市场经济体制的逐步建立，，伴随着计划经济体制下大一统的生产方式向家庭联产承包责任制的全面推行，伴随着中国社会各阶层包括农民阶层利益日益显著的分化过程。城镇化进程不仅伴随中国社会的变革，伴随着失地农民的产生，也伴随着失地农民问题的出现。在中国城镇化进程中，失地农民愈来愈多，在当前的制度安排下，失地农民面临着严重的生存与发展问题。为了既保证城镇化对土地的需求，大量农用土地被正常地征收，又保证失地农民的合法权益得到有效地保障，本文结合当前的政策法规和地方性规章制度，通过对失地农民权益流失的理论分析和实践分析，特别对城镇化进程中失地农民权益保障中存在的问题及其原因探析，并对失地农民的权益保障进行实际调查分析的基础上，提出了对失地农民进行补偿的思路方法及其相应的对策建议。本文从健全现行的土地征用制度、创新失地农民安置方式、促进失地农民的就业、建立健全健全失地农民的社会保障机制等角度对我国城镇化进程中的失地农民权益保障问题提出了建议。
[Abstract]:Urbanization is the inevitable trend of economic and social development. As an inevitable choice for a country to realize industrialization and modernization, urbanization is a kind of social change that every country must experience in the process of industrialization and modernization, and it is also the realization of rural industrialization. The only way to modernize agriculture. China's urbanization process has a distinct and unique Chinese color. The large-scale urbanization process since the reform and opening up coincides with the end of China's planned economic system and the gradual establishment of the socialist market economic system. With the overall implementation of the unified mode of production to the household contract responsibility system under the planned economy system, the interests of all strata of Chinese society, including the peasant stratum, are increasingly marked. The process of urbanization is accompanied not only by the transformation of Chinese society, but also by the emergence of land-lost farmers. In the process of urbanization in China, more and more land-lost farmers are facing serious problems of survival and development under the present system arrangement. In order to ensure the demand of urbanization for land, a large number of agricultural land is normally expropriated, and the legitimate rights and interests of landless farmers are effectively protected, this paper combines current policies and regulations with local rules and regulations. Based on the theoretical and practical analysis of the loss of land farmers' rights and interests, especially the problems existing in the protection of the rights and interests of the landless peasants in the process of urbanization, and on the basis of the actual investigation and analysis of the rights and interests of the landless peasants, This paper puts forward the method of compensation to the land-lost farmers and the corresponding countermeasures and suggestions. In this paper, we should perfect the current land expropriation system, innovate the resettlement method of the land-lost peasants, and promote the employment of the land-lost peasants. From the point of view of establishing and perfecting the social security mechanism of land-lost farmers, the paper puts forward some suggestions on the protection of the rights and interests of land-lost peasants in the process of urbanization in China.
