方正县农村信用社土地经营权抵押贷款研究

【摘要】:农村金融的发展一直受融资难的瓶颈制约着,解决农户贷款难,促进农村金融发展迫在眉睫。而农村土地经营权抵押贷款这一贷款品种的出现,为解决这一难题提供了一种新路径。对农村土地经营权赋予抵押贷款的权利,使土地突破了以往不能抵押的制约,为解决农村经济发展过程中资金不足的问题提供了一种有效的解决方式。目前,土地经营权抵押贷款已经在全国部分地区试点多年,从已试点地区的开展情况来看,该贷款品种对维护农村经济稳定,扩大农户贷款需求,扶贫农户和完善社会主义新农村建设都起到了积极的作用。本文运用实地调研的方法,在阅读大量相关文献后,总结出农村土地经营权和农村土地经营权抵押贷款的相关概念,以产权理论、制度变迁理论、农户借贷行为理论为基础,以黑龙江省方正县农村信用社为研究对象,通过对方正县农村信用社土地经营权抵押贷款的了解,深入分析了方正县农村信用社土地经营权抵押贷款的演进过程和现状,吸取其多年实践中取得的成功经验,总结了方正县农村信用社在土地经营权抵押方面取得的成效,提出方正县农村信用社土地经营权抵押贷款中存在的问题,包括法律界限不清、抵押面积难确定、抵押物处置难、土地经营权价值评估难、贷款风险控制较复杂这五个问题。并通过对方正县农村信用社运用层次分析法,对方正县农村信用社土地经营权抵押贷款的影响因素进行分析,选择4个一级指标和12个二级指标表,构建指标体系,进行一致性检验和综合权重排名,得出信用风险控制水平、信贷体系完善水平、借款人信用、法律法规健全程度和农户基本收入是影响方正县农村信用社土地经营权抵押贷款的主要影响因素。最后,结合各部分的定性分析与定量分析的结果,提出完善方正县农村信用社土地经营权抵押贷款需要从建立良好的法律环境、规范土地经营权抵押贷款程序、健全土地经营权抵押贷款风险控制、加强相关主体的密切协同、加强对农户土地经营权抵押贷款的政策宣传这六个方面进行改善,从而有利于方正县农村信用社进行土地经营权抵押贷款的全面推广。
[Abstract]:The development of rural finance is always restricted by the bottleneck of financing difficulties, so it is urgent to solve the problem of farmers' loans and promote the development of rural finance. However, the emergence of mortgage loan of rural land management right provides a new way to solve this problem. The right to grant mortgage loans to the management right of rural land makes the land break through the restriction which can not be mortgaged in the past and provides an effective way to solve the problem of lack of funds in the process of rural economic development. At present, mortgage loans for land management rights have been piloted in some parts of the country for many years. Judging from the development of the pilot areas, the variety of loans has a great impact on maintaining the stability of the rural economy and expanding the demand of farmers for loans. Poverty alleviation peasant household and perfect socialism new countryside construction all to play a positive role. After reading a large number of related documents, this paper summarizes the related concepts of the rural land management right and the rural land management right mortgage loan, based on the theory of property rights, the theory of institutional change, and the theory of farmers' borrowing behavior. Taking Fangzheng County Rural Credit Cooperative of Heilongjiang Province as the research object, through the understanding of the mortgage loan of land management right of Fangzheng Rural Credit Cooperative, this paper deeply analyzes the evolution process and present situation of the mortgage loan of land management right of Fangzheng County Rural Credit Cooperative. Drawing on its successful experience in practice for many years, this paper summarizes the achievements of Fangzheng Rural Credit Cooperative in the mortgage of land management right, and puts forward the problems existing in the mortgage loan of land management right of Fangzheng Rural Credit Cooperative. It includes five problems, such as unclear legal boundary, difficult to determine the area of mortgage, difficult to dispose of mortgage, difficult to evaluate the value of land management right, and more complicated loan risk control. Through the application of AHP to Fangzheng Rural Credit Cooperatives, this paper analyzes the factors affecting the mortgage loan of land management right of Fangzheng Rural Credit Cooperatives, and selects 4 primary indexes and 12 secondary index tables to construct the index system. Carry on consistency check and comprehensive weight rank, get credit risk control level, credit system perfect level, borrower credit, The degree of perfection of laws and regulations and the basic income of farmers are the main factors that affect the mortgage loan of land management right of Fangzheng Rural Credit Cooperative. Finally, combining the results of qualitative analysis and quantitative analysis of each part, the paper puts forward that to perfect the mortgage loan of land management right of Fangzheng Rural Credit Cooperative, we should establish a good legal environment and standardize the mortgage loan procedure of land management right. Improve the risk control of land management right mortgage loan, strengthen the close coordination of relevant subjects, strengthen the policy propaganda of land management right mortgage loan for farmers, and improve the six aspects. This is conducive to Fangzheng County Rural Credit Cooperatives for the comprehensive promotion of mortgage loans for land management rights.
