征转分离制度的创新研究

【摘要】:在经济快速发展,城镇化、工业化进程加快的背景下,我国实行的土地分属国家和农村集体经济组织所有的土地双轨制正面临着快速发展的市场经济的考验。建设用地的需求远远超过了建设用地供给量、人地矛盾关系越来紧张,这些都加速推动了现行土地审批制度在实践过程中不断显示其存在的问题,比如,土地审批环节较多,时间长,审批所需的材料繁琐复杂,造成土地征收转用审批效率低下,制度成本的高昂,贻误了一些重大工程建设项目的开发进程;相关法律法规的不完善,导致行政权力的滥用和腐败,被征地农民的生产生活得不到保障;以经济效益为目的,盲目征地,无规划不科学的用地,使土地资源闲置与荒废,造成极大浪费等弊端不断显现。在分析现行审批制度弊端的基础上,讨论对土地审批制度改革创新的必要性并且提出改革建议。 近年来,我国部分省市地区逐步开展了征转分离制度的试点工作,并且取得了阶段性的成果。通过对广西、湖南、天津、云南、重庆等多地区土地征转分离实践状况的分析我国土地征转分离制度实施现状。根据土地征收转用审批的差异,讨论土地征转分离制度是否合理。并且得出了在理论和实践中,土地征转分离制度都存在可能性,土地征收和转用相分离是合理的。最后评价了土地征转分离制度的主要成效与经验启示,以及土地征转分离制度对改进和完善新增建设用地指标管理体制的建议。土地征转分离制度创新不是对征转同步制度的改革和推翻,而是对征转同步旧模式牵制的突破,总体来看,征转分离制度的创新发展使得我国土地审批制度更加灵活、更加有效。与此同时,土地征转分离制度的一些具体的创新模式开始逐渐被提出。征转分离制度创新模式并没有固定的逻辑顺序,只是在征收审批和转用审批顺序方面的先后不同而已。 笔者通过对大量文献资料的收集整理并进行认真的分析研究,结合实地调查的客观总结,建议各个地区根据地区的实际发展情况和建设用地供求状况,按需实行具体的土地征转分离制度。笔者在分析过程中,对农用地转用审批和征收审批做了细致的研究,认为两审批通常被捆绑在一起,这样的做法并不合理。农用地转用审批和征收审批在本质方面有着根本的区别,所以笔者认为转用审批和征收审批是可以分离的。同时,总结出征转分离制度在实践中的主要成效,对新增建设用地指标管理体制的完善与改革也起到了重要的启示作用。
[Abstract]:Under the background of rapid economic development, urbanization and rapid industrialization, the land dual track system, which belongs to the state and the rural collective economic organizations, is facing the test of the rapid development of the market economy. The demand for construction land far exceeds the supply of construction land, and the contradiction between people and land is becoming more and more tense. These have accelerated the current land examination and approval system to constantly show its existing problems in the process of practice. For example, there are many links in land approval. Long time, complicated materials needed for examination and approval, low efficiency of land expropriation and approval, high system cost, delay the development process of some major construction projects; The imperfection of relevant laws and regulations leads to the abuse of administrative power and corruption, and the production and life of peasants who have been expropriated can not be guaranteed. For the purpose of economic benefit, land requisition blindly and unplanned and unscientific land use make the land resources idle and waste, resulting in great waste and so on. On the basis of analyzing the malpractice of the current examination and approval system, the necessity of reform and innovation of the land approval system is discussed and the reform suggestions are put forward. In recent years, some provinces and cities of our country have gradually carried out the pilot work of the system of separation of levy and transfer, and have made achievements in stages. Based on the analysis of the practice of land expropriation and separation in Guangxi, Hunan, Tianjin, Yunnan, Chongqing and other regions, the present situation of land expropriation and separation system in China is analyzed. According to the difference of land expropriation and conversion approval, the paper discusses whether the separation system of land expropriation and conversion is reasonable. It is concluded that in theory and practice, the separation system of land expropriation and conversion is possible, and the separation of land expropriation and conversion is reasonable. Finally, the paper evaluates the main achievements and experiences of the separation system of land expropriation and conversion, and the suggestions for improving and perfecting the management system of the newly added construction land index. The innovation of land collection and conversion separation system is not the reform and overthrow of the synchronous system, but a breakthrough in the restraint of the old pattern. In general, the innovation and development of the land collection and transfer separation system makes the land examination and approval system more flexible in our country. More effective. At the same time, some specific innovative models of land expropriation and separation system began to be put forward gradually. There is no fixed logical order in the innovation mode of separation of levy and transfer system, but the order of collecting examination and approval is different from that of transferring approval. By collecting and analyzing a large number of documents and materials, combining with the objective summary of field investigation, the author suggests that each region should be based on the actual development of the region and the supply and demand situation of construction land. According to the need to implement the specific system of separation of land requisition. In the process of analysis, the author makes a careful study on the approval of agricultural land conversion and collection and approval, and thinks that the two approvals are usually bundled together, which is not reasonable. There is a fundamental difference between the approval of agricultural land conversion and the examination and approval of expropriation, so the author thinks that the examination and approval of conversion and collection can be separated. At the same time, it summarizes the main achievements of the separation system in practice and plays an important role in the improvement and reform of the new construction land index management system.
