非公企业工会组建与运行机制研究

【摘要】:改革开放以来,随着经济体制多元化的调整,以私营企业为主的非公有制经济所占的比重越来越大,成为国民经济中的重要组成部分非公有制企业在经济中所占比重不断加大但是由此带来的非公有制企业劳资矛盾的问题也越来越突出工会作为解决劳资矛盾的有效主体,成为非公企业建设的重要部分但是,,由于非公企业工会建设水平不高,运行存在多方面问题,难以发挥工会的作用,导致工人合法权益难以维护劳资矛盾激化等问题因此,加强非公企业工会组建和运行工作,推进非公企业工会职能实现,维护工人合法权益,实现劳资关系和谐,是工会党委和政府等各方面临的重要问题 本文首先界定了企业非公企业工会等相关研究概念,以工会理论劳资关系理论和法团理论为研究基础理论,描述了市场经济体制下非公有制企业劳资关系和工会运行现状并从劳方和资方等微观因素及政治经济文化法律等宏观因素方面进行了分析,在分析工会的组织特点非公企业劳资关系工会的职能地位权利和义务的基础上,提出了非公企业工会职能实现保障体系模型,最后总结并提出了非公企业的组建和运行保障机制建设的基本方案,以期为非公企业建设提供借鉴性意见
[Abstract]:Since the reform and opening up, with the adjustment of the diversified economic system, the proportion of non-public economy dominated by private enterprises is increasing. As an important part of the national economy, the proportion of non-public-owned enterprises in the economy is increasing, but the problems of labor-capital contradictions in non-public-owned enterprises are becoming more and more prominent. The main body. As an important part of the construction of non-public enterprises, it is difficult to give full play to the role of trade unions because of the low level of trade union construction in non-public enterprises and the existence of many problems in operation. As a result, it is difficult to maintain the legitimate rights and interests of workers. Therefore, it is necessary to strengthen the formation and operation of trade unions in non-public enterprises, promote the realization of the functions of trade unions in non-public enterprises, and safeguard the legitimate rights and interests of workers. Realizing the harmonious relationship between Labor and Capital is an important problem faced by the Party Committee and the Government of the Trade Union This paper first defines the related research concepts such as non-public enterprise trade union and so on, taking the labor union theory and the corporation theory as the basic theories. This paper describes the present situation of labor relations and trade unions in non-public enterprises under the market economy system, and analyzes the microcosmic factors such as labor and management, political, economic, cultural, legal and other macro factors. On the basis of analyzing the organizational characteristics of trade unions, the rights and obligations of the functional status of labor relations trade unions in non-public enterprises, this paper puts forward a model of functional security system for trade unions in non-public enterprises. In the end, the paper summarizes and puts forward the basic scheme of the establishment and operation guarantee mechanism of non-public enterprises, in order to provide reference opinions for the construction of non-public enterprises.
