马克思异化理论视角下媒介审判本质研究

【摘要】：本文试图以从哲学的视角,运用马克思异化理论分析当下在媒介领域出现的媒介审判现象,在异化关系中,人始终作为异化的主体,生产劳动领域是异化的客体。在媒介审判中存在多重异化现象,媒介审判的主客体与媒介审判异化的主客体并非一致,因此二者的主客体关系也并不相同。本文以郭美美为案例,从媒介审判的主体、客体及主客体关系等方面分析媒介审判的本质。并试图建构一种媒介参与司法审判的理想模式。唯物史观的马克思异化理论,认为异化的存在具有普遍性,在社会发展的过程中,政治、经济、文化、精神等领域都会出现异化现象。我国尚处于社会主义的初级阶段,在发展社会主义的过程中衍生出来的问题有很多,很多领域出现了异化问题,包括媒体领域中出现的媒介审判问题。媒介审判现象的是对司法审判权利和个人权利的双重侵犯,严重危害了社会秩序,对社会造成了很大的危害和影响。各大学者以魏永征教授关于媒介审判的概念为依据,纷纷提出自己的观点和看法。大多数学者都是对“媒介审判”进行批判,但都是简单的进行主客体关系的批判,都是进行的生活上的批判,经验的批判,没有上升到哲学的批判,而哲学的批判作为最深层次上的批判,哲学追求万物本质。所以从马克思异化理论来分析当下媒介审判现象会更有意义。
[Abstract]:This paper tries to use Marx's alienation theory to analyze the phenomenon of media trial in the field of media from the perspective of philosophy. In the alienation relationship, the human being is always the subject of alienation, and the field of production and labor is the object of alienation.There is a phenomenon of multiple alienation in the media trial, the subject and object of the media trial are not the same as the subject and object of the alienation of the media trial, so the relationship between the subject and the object is not the same.Taking Guo Meimei as a case, this paper analyzes the nature of media trial from the aspects of subject, object and relationship between subject and object.And try to construct an ideal mode of media participation in judicial trial.Marx's theory of alienation in historical materialism holds that the existence of alienation is universal and alienation will occur in the fields of politics economy culture and spirit in the process of social development.Our country is still in the primary stage of socialism, in the process of developing socialism, there are many problems, many areas appear alienation problems, including the media trial in the media field.The phenomenon of media trial is a double violation of judicial and individual rights, which seriously endangers the social order and causes great harm and influence to the society.On the basis of Professor Wei Yongzheng's concept of media trial, scholars put forward their own views and opinions one after another.Most scholars criticize the "medium trial", but they are simply criticizing the relationship between subject and object, the criticism of life, the criticism of experience, but not the criticism of philosophy.The philosophy of criticism as the deepest level of criticism, philosophy pursues the essence of all things.Therefore, it will be more meaningful to analyze the phenomenon of media trial from Marx's alienation theory.
