【摘要】：随着社会经济的发展以及科学技术的提高，我国著作权方面的问题越来越多，也越来越复杂。我国不仅通过司法方式来保护著作权，也通过行政方式来保护著作权，是一种行政保护和司法保护相结合的“双轨制”保护模式，它们之间相互补充、相互配合，但必须遵守司法最终保护原则。行政保护具有中国特色，但是并非我国独有的。著作权行政保护是我国著作权制度中的重要的组成部分，是我国对著作权进行管理的重要手段之一，有助于著作权制度在我国构建创新型国家过程中发挥作用，所以我国需要加强著作权行政保护。文章以我国著作权行政保护为对象，采用理论与实践相结以及国内外比较的方法，探讨完善我国著作权行政保护的建议，期望对我国著作权行政保护理论和实践有参考价值。文章第一部分介绍了我国著作权行政保护制度的基本理论，，分别阐述了著作权行政保护制度的涵义、特征以及地位三个方面；第二部分论述了著作权行政保护制度存废之争及我国著作权行政保护制度继续存在的原因；第三部分简要分析对国外著作权行政保护现状及对我国的启示；第四部分着重分析了我国著作权行政保护的现状及问题，分别从立法、执法、公民著作权意识、地方保护主义以及行政保护与司法保护之间的衔接五个方面分析了我国著作权行政保护存在的问题；第五部分针对我国著作权行政保护存在的问题，探讨了完善我国著作权行政保护的建议，这些建议与其存在的问题是相对应，同样是从立法、执法、公民著作权意识、地方保护主义以及行政保护与司法保护之间的衔接五个方面进行阐述。
[Abstract]:With the development of social economy and the improvement of science and technology, there are more and more problems of copyright in China. Our country not only protects the copyright through the judicial way, but also protects the copyright through the administrative way. It is a kind of "two-track system" protection mode which combines the administrative protection with the judicial protection. They complement each other and cooperate with each other. But the principle of ultimate judicial protection must be observed. Administrative protection has Chinese characteristics, but it is not unique to our country. The administrative protection of copyright is an important part of the copyright system in our country and one of the important means to manage the copyright in our country. It helps the copyright system to play a role in the process of building an innovative country in our country. Therefore, our country needs to strengthen the administrative protection of copyright. This paper takes the administrative protection of copyright in our country as the object, adopts the combination of theory and practice and the method of comparison at home and abroad, and probes into the suggestion of perfecting the administrative protection of copyright in our country, which is expected to be of reference value to the theory and practice of the administrative protection of copyright in our country. The first part of the article introduces the basic theory of the copyright administrative protection system in China, and expounds the meaning, characteristics and status of the copyright administrative protection system. The second part discusses the dispute of the copyright administrative protection system and the reason why the copyright administrative protection system of our country continues to exist, the third part briefly analyzes the present situation of the foreign copyright administrative protection and its enlightenment to our country. The fourth part focuses on the analysis of the current situation and problems of the administrative protection of copyright in China, respectively from the legislation, law enforcement, citizen copyright awareness, The local protectionism and the connection between the administrative protection and the judicial protection have analyzed the problems existing in the administrative protection of copyright in our country, the fifth part is aimed at the problems existing in the administrative protection of copyright in China. This paper discusses the suggestions for perfecting the administrative protection of copyright in our country. These suggestions correspond to the existing problems, such as legislation, law enforcement and citizen's copyright consciousness. Local protectionism and the connection between administrative protection and judicial protection are expounded.
