网络环境下私人复制问题研究

【摘要】：随着网络的发展，私人复制者的复制能力和传播能力得到空前的提高，一些享有著作权的作品在互联网上被肆意传播，并在一定程度上影响到了著作权人的经济利益，私人复制者与著作权人之间的矛盾也随之日益尖锐。昔日属于合理使用的私人复制，在如今的网络时代能否理所当然地归入合理使用的范围呢？对此，各国纷纷在立法上作出了回应，并采取了相应的措施对私人复制进行一定程度的规制，，以期做到既能保证公众对私人复制的合理使用，又不致于过份地损害到著作权人的利益。然而，传统的处理办法存在诸多的缺陷和不足，其无法很好地解决网络环境下私人复制的问题，因此有必要在当前的网络环境下为私人复制问题寻找新的解决途径。本文以网络环境下私人复制的基础理论为起点，全面分析了私人复制的概念，探讨了私人复制在网络环境下所呈现出的新特点、网络环境下私人复制的定性以及网络环境下私人复制的合理使用标准，以此来引出本文的主题。第二部分重在介绍国际公约与世界各国关于私人复制问题的不同应对之策。除了颁布相应的立法之外，各国还专门针对私人复制问题安排了一系列的配套制度，如德国的补偿金制度、美国的第三人责任制度以及其他诸如数字权利管理制度等等。第三部分探讨了我国针对网络环境下私人复制问题的解决途径。该部分首先介绍了我国对网络环境下私人复制问题的态度以及相关立法规范的不足，接着提出了在我国现行的体制下如何完善网络环境下私人复制制度的对策。本文的结论是改造合理使用制度，辅之以版权金制度、数字权利管理和新型商业模式等各种途径，从而共同解决网络环境中的私人复制问题。
[Abstract]:With the development of the network, private replicators' reproduction ability and dissemination ability have been improved unprecedented, some works that enjoy copyright have been wantonly spread on the Internet, and to a certain extent have affected the economic interests of copyright owners. The contradiction between private replicators and copyright owners has become increasingly acute. Can private reproduction, which used to be reasonably used, fall naturally into the realm of rational use in today's Internet age? In response to this, many countries have responded in legislation and adopted corresponding measures to regulate private reproduction to a certain extent, in order to ensure the rational use of private reproduction by the public. It does not unduly harm the interests of copyright owners. However, there are many defects and shortcomings in the traditional approach, which can not solve the problem of private replication in the network environment. Therefore, it is necessary to find a new solution to the private replication problem in the current network environment. Based on the basic theory of private replication in the network environment, this paper analyzes the concept of private replication and discusses the new characteristics of private replication in the network environment. The definition of private replication in network environment and the standard of rational use of private copy in network environment lead to the theme of this paper. The second part mainly introduces the international convention and the different countermeasures of private reproduction in the world. In addition to enacting corresponding legislation, countries have also arranged a series of supporting systems for private reproduction, such as the compensation system in Germany, the third party liability system in the United States and other systems such as the digital rights management system and so on. The third part discusses how to solve the problem of private replication in the network environment. This part first introduces the attitude of our country to the problem of private replication under the network environment and the deficiency of the relevant legislation and regulations, and then puts forward the countermeasures of how to perfect the private replication system under the network environment under the current system of our country. The conclusion of this paper is to reform the system of rational use, supplemented by copyright fund system, digital rights management and new business model, so as to solve the problem of private reproduction in the network environment.
