网页快照的著作权问题研究

【摘要】：随着全球互联网用户对于网页搜索、网页访问速度和访问稳定性需求的增加,互联网上各种搜索引擎技术应运而生,网页快照技术即是其中之一。作为一个新兴技术,网页快照技术一方面给网络用户和网站经营者带来诸多便利,但另一方面也给网页著作权人带来了许多不利的影响。目前我国著作权法关于该技术的规定仍是一片空白,因此,在司法实践中应当如何认定网页快照技术的性质,如何规范网页快照技术的使用,如何保护网站著作权人的合法权益等问题,急需理论界和司法实务界做出及时回应。鉴于此,本文以网页快照这一新技术为切入点,在理论上分析和探讨网页快照技术的性质,结合司法实务分析网页快照技术带给我国著作权法的挑战,以及我国司法实践中应该如何予以应对等问题。文中笔者以网页快照技术作为微观的切入点,并以点带面在宏观角度上尝试探讨我国著作权法在今后应对诸多新挑战的策略。 目前学术界关于网页快照技术已经达成的基本共识是:首先,网页快照服务兼具有ICP和ISP的性质。因此在这种侵权主体分类下进行的侵权以及免责事由研究已经意义不大。本文从行为本身进行分析和研究,舍弃了侵权主体分类研究的模式。其次,对于网页快照技术可以提高访问速度,促进信息的传播,给用户和网站经营者带来的利大于弊,这些也是毋庸置疑的。因此争议的焦点主要集中在:怎么样建立一种能够衡平促进技术发展、保护著作权人利益以及公众利益的著作权制度体系,同时能够为新技术发展预留出具有弹性的制度空间,此即本文研究的重点。 本文一共分为引言和四个章节,引言主要介绍了网页快照产生的网络背景和近期围绕网页快照问题产生的纠纷以及理论界的争议,以期说明本文的研究背景和意义。第一章,网页快照概述。本章简要概述网页快照的概念,运行原理,并和单纯的提供链接行为、系统缓存进行横向的对比,为下文的论述做铺垫。第二章,网页快照中的著作权专有权利分析。把网页快照放入著作权保护的各项专有权利中进行分析,对网页快照进行定性。论述网页快照的本质,对应著作权法中的什么行为,侵犯了著作权人的什么权利,存在哪些争议等。第三章,网页快照侵权的抗辩事由。分析网页快照在著作权侵权认定中是否可以适用阻却侵权的事由,即是否适用合理使用、默示许可和避风港规则。第四章,网页快照与我国著作权法制度的完善。总结在我国著作权法制度下认定网页快照合法性的总体思路,并提出在网页快照这一新技术的运用中,如何平衡著作权人利益、促进技术发展和保护公众利益的具体建议,在我国建立有限制的默示许可制度,以及完善合理使用制度立法等。
[Abstract]:With the increasing demand for web search, web page access speed and access stability for the global Internet users, various search engine technologies emerge as the times require on the Internet, among which page snapshot technology is one of them. As a new technology, web snapshot technology not only brings a lot of convenience to network users and website operators, but also brings a lot of adverse effects to the copyright owners of web pages. At present, the regulation of this technology in copyright law of our country is still a blank. Therefore, in judicial practice, how to determine the nature of web page snapshot technology, how to standardize the use of web page snapshot technology, How to protect the legitimate rights and interests of copyright owners on websites is in urgent need of prompt response from the theorists and judicial practitioners. In view of this, this article regards the new technology of web page snapshot as the breakthrough point, theoretically analyzes and discusses the nature of the web page snapshot technology, and analyzes the challenge of the web page snapshot technology to the copyright law of our country in combination with the judicial practice. And how to deal with the problems in the judicial practice of our country. In this paper, the author takes the technology of web page snapshot as the microcosmic entry point, and tries to explore the strategies of Chinese copyright law to deal with many new challenges in the future from the macro point of view. At present, the academic community has reached a basic consensus on the technology of web page snapshot: first of all, web snapshot service has the nature of both ICP and ISP. Therefore, it is of little significance to study the subject of tort and exemption under the classification of torts. This paper analyzes and studies the behavior itself, abandoning the model of the classification of torts. Secondly, for the web page snapshot technology can improve the speed of access, promote the dissemination of information, to users and website operators bring more benefits than disadvantages, these are beyond doubt. Therefore, the focus of the controversy is mainly on: how to establish a copyright system that can balance the development of technology, protect the interests of copyright owners and the public interest, and at the same time reserve flexible institutional space for the development of new technologies. This is the focus of this paper. This paper is divided into introduction and four chapters. The introduction mainly introduces the network background of web page snapshot, the recent disputes around the issue of web page snapshot and the controversy in theory, in order to explain the research background and significance of this paper. The first chapter is an overview of web page snapshots. This chapter gives a brief overview of the concept, operation principle, and provides the link behavior, system cache to carry on the horizontal contrast with the simple provides the link behavior, paves the way for the following discussion. The second chapter, the copyright exclusive rights analysis in the web page snapshot. Put the web snapshot into the copyright protection of the exclusive rights to analyze the nature of the page snapshot. This paper discusses the nature of web page snapshots, what acts in copyright law, which rights of copyright owners have been infringed, and what disputes exist and so on. The third chapter, the defense reason of the page snapshot infringement. This paper analyzes whether web snapshot can be applied to prevent infringement in copyright infringement, that is, whether it is applicable to reasonable use, implied permission and safe haven rules. Chapter four, the snapshot of the web page and the perfection of the copyright law system of our country. This paper summarizes the general idea of determining the legality of web page snapshot under the copyright law system of our country, and puts forward some concrete suggestions on how to balance the interests of copyright owners, promote the development of technology and protect the public interest in the application of the new technology of web snapshot. Establish a restricted implied license system and perfect the legislation of rational use system in our country.
