党内法规视野下的高校腐败治理研究

【摘要】:中国特色反腐倡廉道路坚持党内法规与国家法律双轮驱动,党内法规是政治保障,国家法律是法律保障,二者相辅相成、统一于中国特色社会主义法治体系。党内法规是反腐的利器,也是中国反腐倡廉的优势所在。随着依法治国与依规治党的推进,从党内法规的视野强化高校腐败治理,具有紧迫性和必然性。与其他领域相比,高校腐败现象,既有共性,也有自身的独特之处。深入研究高校腐败现象,把握高校腐败规律,是高校腐败治理的前提。本文从腐败现象的本质入手,对高校腐败的概念作了界定,认为高校腐败是对高校办学自主权的滥用和对高校公共资源的非规范使用。研究发现,高校腐败现象严峻复杂,集中体现为:腐败数量多发、腐败重点突出、腐败危害巨大。关于高校腐败的原因,从党内法规的视角来看,党员个人、党组织、党内法规三个层面都或多或少地存在一些突出问题。具体而言:一是党员个人党内法规理论修养缺乏、自律意识差,对党内法规没有内化于心、外化于行;二是党组织责任意识不强,党的建设弱化、管党治党宽松软,党内法规源头教育不到位、监督不落实、惩治不及时;三是党内法规体系不健全,法规不完善、纪法不衔接、配套不完备,造成执行中的困难。高校腐败治理是一项系统性工程,党内法规视野下的高校腐败治理,需要从党员个人、党组织、党内法规三个方面共同推进,最终达到"不想腐、不敢腐、不能腐"的治理成效。党员个人层面,强化党内法规理论学习,将党内法规内化于心;提升党性修养,培养规矩意识,让党内法规外化于行。党组织层面,一是要健全教育机制、完善教育过程,构筑源头防腐机制;二是要完善监督体系,强化党内民主监督、规范纪检专职监督、提升巡视监督力度,构筑不能腐的立体监督机制;三是强化问责处分,推动责任担当,构筑不敢腐的惩戒机制。党内法规层面,一是完善党内立法,规范法规体系;二是推动纪法衔接,保障纪法有效运行;三是健全配套保障,提升法规执行的有效性。
[Abstract]:The road of fighting corruption and promoting clean government with Chinese characteristics insists on the driving force of inner-party laws and national laws, which is political guarantee and national law is legal guarantee. They complement each other and are unified in the socialist legal system with Chinese characteristics. Party laws and regulations are the weapon of anti-corruption and the advantage of anti-corruption in China. With the advancement of governing the country according to law and governing the Party according to rules, it is urgent and inevitable to strengthen the corruption management in colleges and universities from the perspective of inner-party laws and regulations. Compared with other fields, corruption in colleges and universities has its own characteristics as well as commonalities. It is the premise of corruption management in colleges and universities to study the corruption phenomenon and grasp the law of corruption in colleges and universities. Starting from the essence of corruption, this paper defines the concept of corruption in colleges and universities, and holds that corruption in colleges and universities is the abuse of the autonomy of running schools and the non-standard use of public resources in colleges and universities. It is found that corruption in colleges and universities is severe and complex, which is reflected in the high number of corruption, the prominent emphasis of corruption and the great harm of corruption. On the reasons of corruption in colleges and universities, from the perspective of inner-party laws and regulations, there are more or less some outstanding problems in the three levels of individual Party members, party organizations and inner-party laws and regulations. To be specific: first, the party members lack theoretical accomplishment of the laws and regulations within the Party, have poor sense of self-discipline, do not internalize the laws and regulations within the party, and externalize the laws and regulations within the party; second, the sense of responsibility of the party organizations is not strong, the party building is weakened, and the party's administration of the party is loose and soft. Third, the inner-party laws and regulations system is not perfect, the laws and regulations are not perfect, the discipline law is not connected, and the supporting system is not complete, resulting in difficulties in the implementation. The governance of corruption in colleges and universities is a systematic project. Under the vision of inner-party laws and regulations, the governance of corruption in colleges and universities needs to be promoted from three aspects: individual party members, party organizations, and inner-party laws and regulations, so as to achieve "do not want to corrupt, do not dare to corrupt," Can not rot "the effect of governance." At the level of individual Party members, we should strengthen the theoretical study of inner-party laws and regulations, internalize the inner-party laws and regulations, enhance the self-cultivation of the Party spirit, cultivate the sense of rules and regulations, and let the inner-party laws and regulations be externalized. At the level of party organizations, one is to perfect the educational mechanism, the other is to perfect the educational process, and to construct the source anticorrosion mechanism; the other is to perfect the supervisory system, strengthen the democratic supervision within the party, standardize the full-time supervision of discipline inspection, and enhance the intensity of inspection and supervision. The third is to strengthen accountability, promote responsibility, and construct punishment mechanism that dare not rot. At the level of inner-party laws and regulations, the first is to perfect the inner-party legislation and to standardize the legal system; the other is to promote the convergence of discipline laws to ensure the effective operation of disciplinary laws; third, to improve the supporting safeguards and enhance the effectiveness of the enforcement of laws and regulations.
