网络举报的反腐效用问题研究

【摘要】：自十八大以来,反腐败已然成为关系党和国家生死存亡的重要议题。党和人民以强烈的历史责任感、深沉的使命忧患感、顽强的意志品质推进党风廉政建设和关乎社稷民生、国家命运的反腐败斗争。但在网络飞速发展、移动终端技术快速普及的大环境下,反腐败工作的顺利开展则需要依赖不断革新的手段与方式,这就给了网络举报这种新型反腐方式应运而生、就势而起的机会。网络举报这种新型反腐方式的效用发挥关系到服务型、信用型、民主型、法治型和回应型政府的建设,公众民主自由权利的保障与和谐社会文明程度的提升,所以要借鉴国内外相关理论成果和实践经验,运用文献、比较及案例等研究方法,对网络举报的生发机理、反腐功效和应用,以及其中存在的诸多问题予以研究解决,力求从网络举报主体、媒介及制度法律等方面进行创新性研究探索,谋求新的突破。本篇文章在研究过程中主要依循以下研究路径:首先,在国内外学者的前期研究基础之上,通过汇总整理来明晰网络举报的内涵、外延和特点;其次,通过分析其生发机理,挖掘其中可产生反腐效用的具体内容及其影响,这其中主要分析的是其正面影响;再次,分析网络举报反腐效用发挥中存在的问题,以及造成这些问题的原因;最后,提出合理利用网络举报,使其产生巨大反腐效用的对策,为规范政府权力运行和监督官员行为操守做出贡献。
[Abstract]:Since the 18th National Congress, anti-corruption has become a vital issue for the survival of the Party and the country. The Party and the people have a strong sense of historical responsibility, a deep sense of mission distress, a strong will to promote the construction of a clean and honest party, and a struggle against corruption related to the people's livelihood and the fate of the country. However, with the rapid development of network and the rapid popularization of mobile terminal technology, the smooth development of anti-corruption work needs to rely on the means and methods of continuous innovation, which gives the network reporting this new way of anti-corruption came into being. An opportunity to rise to the occasion. The effectiveness of this new type of anti-corruption report is related to the construction of service-oriented, credit-based, democratic, law-based and responsive government, the protection of the public's democratic and free rights and the improvement of the civilization of a harmonious society. So we should draw lessons from relevant theoretical achievements and practical experiences at home and abroad, and use literature, comparison and case studies to study and solve the mechanism, anti-corruption efficacy and application of network reporting, as well as many existing problems. In order to seek a new breakthrough, the author tries to carry on the innovative research and exploration from the network report subject, the media and the system law and so on. This article mainly follows the following research path in the research process: first, on the basis of the previous research of domestic and foreign scholars, through the summary and arrangement to clarify the connotation, extension and characteristics of the network report; secondly, through the analysis of its growth mechanism, Excavate the concrete content and its influence that can produce the anti-corruption utility among them, among which the main analysis is its positive influence; thirdly, analyze the problems existing in the use of network report anti-corruption utility, and the causes of these problems; finally, The paper puts forward the countermeasures of making use of the network report reasonably to make it produce huge anti-corruption effect, and make contribution to standardize the operation of the government power and supervise the behavior and conduct of the officials.
