完善党委决策制度的法学思考

【摘要】：科学、民主、依法决策是保证党正确决策的基本原则,其中,依法决策具有统领性地位。党委依法决策既要依照实体规范,又要依照程序规范;既要依照宪法法律,又要依照党章党规。发扬党内民主、保障党员权利,是实现正确决策的重要途径。党章关于党员权利的规定都属于政治参与性质的民主权利,党员"义务优先"的根本目的在于更好服务于党和人民的事业。完善党委决策制度的一个重要目标是以党内法规形式制定地方党委决策程序规定,对调查研究、拟订方案、专家咨询、征求意见、风险评估、合法合规性审查、集体讨论决定等基本环节作出具体规定。党委决策权是宪法性权力,有权就有责,失责必追究。决策责任是政治性的宪法责任,其归责不应考虑主观过错,而只论客观后果。
[Abstract]:Scientific, democratic and legal decision-making is the basic principle to ensure the Party's correct decision-making, among which, the decision-making according to law has the dominant position. Party committees should make decisions in accordance with both substantive and procedural norms according to the laws of the Constitution and the Party rules of the Party Constitution. Developing inner-party democracy and protecting party members' rights is an important way to realize correct decision-making. The provisions of the Party Constitution on the rights of Party members belong to the democratic rights of political participation, and the fundamental purpose of Party members'"obligation first" is to better serve the cause of the Party and the people. One of the important goals of perfecting the decision-making system of the Party committees is to formulate the rules and regulations of the decision-making procedures of the local party committees in the form of inner-party laws and regulations, to investigate and study, to draw up plans, to consult with experts, to solicit opinions, to assess risks, and to examine the legality of compliance. Collective discussion decisions and other basic links to make specific provisions. Party committee decision-making power is constitutional power, the right to have responsibility, default will be investigated. Decision-making responsibility is a political constitutional responsibility, its imputation should not consider the subjective fault, but only the objective consequence.
