纪委与监察委员会合署办公的理论内涵、现实意义与优化路径

【摘要】:对权力的监督与制约一直是执政党建设的核心问题之一。强化对权力的监督与制约,既是法治中国建设的关键所在,也是党风廉政建设和反腐败斗争要解决的核心问题,更是推进国家治理体系与治理能力现代化的重要途径。中国共产党长期执政,面临的重大问题之一就是对权力的监督。全面从严治党,最终是要探索出一条党长期执政条件下实现自我监督的有效途径。《纪委与监察委员会合署办公的理论内涵、现实意义与优化路径》一文指出,纪委与监察委员会合署办公是国家监察体制改革的一项重要内容。从权力监督视角出发,纪委与监察委员会合署办公的理论内涵体现为两者在监督主体、监督对象、监督内容和监督手段四个方面的分工与融合。纪委与监察委员会合署办公具有加强和改善党对反腐败工作的领导、优化中国特色社会主义权力监督体系的主体结构与内容结构、提升我国治理腐败的有效性和合法性等现实意义。《公私之辨:权力监督目的的生态学分析》一文指出,立足生态学的视角,监督主体的私利有其必然性与合理性,但持续膨胀的私利则会掣肘权力监督的应有效能,引发权力与权利的互抑与失衡,加剧监督生态的退化。为此,权力监督应当追求监督目的的公益化,实现监督双方的共生互利,进而统领和规范多样性的监督诉求,确保监督生态的整体性、平衡性和持续优化。《权力规制:政治秩序场域中利益集团的消极行为》一文指出,对利益集团消极行为的规制,中国应着眼于政府自主性、执政党自身建设和公民个体的政治理性来增强政治实体的防范能力,着眼于严格执行政治制度、增加政治制度供给和营造政治生态来发挥政治规则的效力,着眼于强化政治权威、掌控政治资源和彰显法治来提高政治控制的水平。三篇文章皆有真知灼见,期望通过本期的讨论,给全面从严治党的相关研究和工作实践提供更多的理论解读和实践参考。
[Abstract]:The supervision and restriction of power has always been one of the core problems in the construction of the ruling party. To strengthen the supervision and restriction of power is not only the key to the construction of China under the rule of law, but also the core problem to be solved in the construction of the party style and clean government and the struggle against corruption. It is also an important way to promote the modernization of the national governance system and governance capacity. One of the major problems the CPC faces in its long-term administration is the supervision of power. Finally, we should explore an effective way to realize self-supervision under the long-term ruling conditions of the Party. The article "the theoretical connotation, practical significance and Optimization path of Co-office of Disciplinary Commission and Supervision Commission" points out that It is an important content of the reform of the state supervision system that the discipline Inspection Commission and the Supervision Commission are co-located. From the perspective of power supervision, the theoretical connotation of co-office work of discipline Inspection Commission and Supervision Committee is embodied in the division and integration of supervision subject, object, content and means of supervision. The co-location of the discipline Inspection Commission and the supervisory committee will strengthen and improve the Party's leadership in anti-corruption work and optimize the main structure and content structure of the socialist power supervision system with Chinese characteristics. It is pointed out in this article that based on the ecological perspective of ecology, the self-interest of the subject of supervision has its inevitability and rationality. However, the self-interest will restrict the efficiency of power supervision, cause the mutual inhibition and imbalance between power and rights, and aggravate the degradation of supervision ecology. Therefore, power supervision should pursue the commonweal aim of supervision, realize the symbiosis and mutual benefit of both sides of supervision, and then lead and standardize the demands of supervision of diversity, and ensure the integrity of supervision ecology. Power Regulation: negative behavior of interest groups in the political order Field. The article points out that China should focus on the autonomy of government to regulate the negative behavior of interest groups. The ruling party itself and the political rationality of the individual citizens to enhance the political entity's ability to guard, with a view to strictly implementing the political system, increasing the supply of the political system and creating a political ecology to give play to the effectiveness of political rules. Focus on strengthening political authority, control political resources and highlight the rule of law to improve the level of political control. All the three articles have insight and hope to provide more theoretical interpretation and practical reference for the related research and work practice of managing the Party strictly and comprehensively through the discussion in this issue.
