未成年人网络保护条例的立法

【摘要】：十八届四中全会提出完善以宪法为核心的中国社会主义法律体系,这是依法治国的一个基本前提。未成年人网络保护条例的起草是我国目前完善和加强重点领域立法的一个重要举措。征求意见稿的基本思路在于处理好各类法律主体权利、义务的关系和引导、预防、惩罚的关系,处理好国家干预和行业自律的关系,处理好网络创新行业发展与未成年人权利保护的关系,处理好表达自由和法律监管的关系。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee proposed to perfect China's socialist legal system with the Constitution as the core, which is a basic prerequisite for governing the country according to law. The drafting of the regulations on the protection of minors is an important measure to perfect and strengthen the legislation in the key areas. The basic ideas of the draft for soliciting opinions lie in handling the relationship and guidance of the rights and obligations of various legal subjects, the relationship between prevention and punishment, and the relationship between state intervention and industry self-discipline. To deal with the relationship between the development of network innovation industry and the protection of minors' rights, and the relationship between freedom of expression and legal supervision.
