论党纪反腐与司法反腐

【摘要】：党纪反腐是执政党运用党内法规治理腐败的职能活动,是党的纪律检查机关对党员腐败行为的纪律评价和纪律处置。司法反腐是司法机关依据国家法律对腐败行为进行法律评价和处置的职能活动。在法治反腐的语境下,党纪反腐严于司法反腐,司法反腐强化党纪反腐,党的执纪与国家司法在腐败治理中各司其职、相辅相成,共同实现"把权力关进制度笼子里"的预防价值。
[Abstract]:Anti-corruption of Party discipline is the functional activity of the ruling party to manage corruption by using inner-party laws and regulations, and it is also the disciplinary evaluation and disciplinary treatment of the Party's disciplinary inspection organ to the corrupt behavior of party members. Judicial anti-corruption is the function of judicial organs to evaluate and deal with corruption according to national laws. In the context of anti-corruption under the rule of law, party discipline is stricter than judicial anti-corruption, judicial anti-corruption strengthens party discipline anti-corruption, and the party's discipline and national judicature perform their respective duties and complement each other in the governance of corruption. Jointly realize the preventive value of "putting power in the cage of the system".
