防腐视角下官员个人有关事项报告制度的法理基础

【摘要】：全面从严治党是加强党的建设、保持党的先进性纯洁性及夯实党的执政地位的重要战略。全面从严治党重在从严治吏。在我国,通过执政党党内法规建立、完善和实施的领导干部报告个人有关事项制度,是全面从严治党和从严治吏的集中体现。在反腐倡廉建设的长期实践中,我国官员个人有关事项报告制度从无到有、从粗到细,并不断完善,党的十八大后其实施力度不断加大,立法目的得以较为充分地实现。从法理上看,该项制度蕴含着克减官员隐私和满足公众知情、彰显预防和治本理念、考验官员诚信和激励自证清白、排除合理怀疑和监督制约权力等丰富的防腐治腐法治精神。
[Abstract]:Comprehensive and strict administration of the Party is an important strategy to strengthen the Party's construction, to maintain the Party's progressiveness and to consolidate the Party's ruling position. Strict administration of the Party in an all-round way lay in strict administration of officials. In our country, the system of reporting personal affairs by leading cadres, which is established, perfected and implemented by the ruling party's inner-party laws and regulations, is the concentrated embodiment of overall strict administration of the Party and strict administration of officials. In the long-term practice of building anti-corruption and building clean government, the reporting system of personal related matters of officials in our country has developed from scratch, from coarse to fine, and has been continuously improved. After the 18th National Congress of the Party, the implementation of the system has been continuously strengthened, and the legislative purpose has been fully realized. From the point of view of legal theory, this system contains rich spirit of anticorrosion, corruption and rule of law, such as abridging officials' privacy and satisfying the public's knowledge, demonstrating the concept of prevention and cure, testing officials' honesty and encouraging themselves to prove their innocence, eliminating reasonable doubts and restricting power, and so on.
